The Planning Director has completed a review of your request to park a recreational vehicle
within the front yard setback of 5350 El Arbol Drive, pursuant to Section 21.44.060 of the
Carlsbad Municipal Code. After careful consideration of the circumstances surrounding this
request, the Planning Director has determined that the findings required for-allowing the parking
of a recreational vehicle in the front yard setback can be made and therefore APPROVES the
request, based on the following findings:
Findings:
1. That parking in or access to the side or rear yard WILL require structural alteration to the
existing residence or will require the removal of significant or unique landscaping in that •
the northern side yard is 5 feet and the southern side yard is 7 feet wide, both of
which are narrower than the 8.5 foot width of the recreational vehicle.
Furthermore, there is extensive mature landscaping within the side yards which
would be required to be removed in order to access the side yard.
2. That parking of the recreational vehicle in or access to the side or rear yard WILL NOT
require extensive grading to the side or rear yard.
3. Parking of the recreational vehicle in the front yard WILL NOT interfere with visibility to
or from El Arbo! Drive in that adequate sight distance is provided and the lot in
question is an interior lot.
4. That the recreational vehicle WILL NOT interfere with traffic on the street or sidewalk or
encroach into the street and utility right-of-way in that the recreational vehicle does
not encroach into the public right-of-way since the recreational vehicle is set back
20 feet from the right-of-way.
Conditions:
1. Approval is grantecffor AV 09-02 as shown on Exhibits "A", dated December 10, 2009,
on file in the Planning Department and incorporated herein by reference. Development
shall occur substantially as shown unless otherwise noted in these conditions.
This decision may be appealed by you or any member of the public to the Planning Commission
within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning
Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $613.00. The filing

of such appeal within such time limit shall stay the effective date of the order of the Planning
Director until such time as a final decision on the appeal is reached. If you have any questions
