Adopt a resolution accepting a compliance report on the status of all state-mandated annual
fire inspections in the City of Carlsbad.
Executive Summary
Local fire departments are required to perform annual fire inspections of all public and private
schools, hotels, motels, lodging houses, apartment houses and condominium buildings under
California Health and Safety Code Sections 13146.2 and 13146.3. In addition, a compliance
report must be provided to its administrating authority each year in accordance with
Section 13146.4.
This report confirms that all initial annual fire inspections for fiscal year 2025-26 have been
completed.
Explanation & Analysis
Annual fire inspections play a critical role in reducing community risk by identifying and
mitigating known hazards, ensuring compliance with the California Fire Code, and confirming
the maintenance and functionality of fire protection systems. These inspections also verify safe
and accessible egress routes, the integrity of fire-protective construction, and adequate site
access for emergency personnel.
Inspection summary for fiscal year 2025-26:
•The Carlsbad Fire Department inspected 43 hotels and motels, totaling 166 buildings.
•The Fire Department inspected 2,201 apartment buildings, defined as structures with
three or more attached dwelling units, excluding duplexes. In accordance with the
California Building Code, condominiums are also classified and inspected as apartment
buildings.
•The Fire Department inspected 38 public and private schools, totaling 271 buildings.

The department conducted mandated inspections of 2,638 buildings during fiscal year 2025-26,
successfully inspecting all known buildings and structures subject to state requirements.
By approving the proposed resolution, the City Council formally acknowledges receipt of this
report and affirms the city’s compliance with the Health and Safety Code requirements, thereby
fulfilling its statutory obligations.

The proposed action is not a “project” as defined by California Environmental Quality Act, or
CEQA, Section 21065 and CEQA Guidelines Section 15378(b)(5) and does not require
environmental review under CEQA Guidelines Section 15060(c)(3) and 15061(b)(3), because the
proposed action to report on annual fire inspection compliance is an organizational or
administrative government activity that does not involve any commitment to any specific
project which may result in a potentially significant physical impact on the environment. Any
subsequent action or direction stemming from the proposed action may require the
preparation of an environmental document in accordance with CEQA or the CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING A COMPLIANCE REPORT ON THE STATUS OF ALL
STATE-MANDATED ANNUAL FIRE INSPECTIONS IN THE CITY OF CARLSBAD
WHEREAS, California Health and Safety Code Sections 13146.2 and 13146.3 require all fire
departments that provide fire protection services to perform annual inspections in every building used
as a public or private school, hotel, motel, lodging house, apartment house and certain residential care
facilities for compliance with building standards, as provided; and
WHEREAS, California Health and Safety Code Section 13146.4 requires all fire departments that
provide fire protection services to report annually to their administering authority on compliance with
Sections 13146.2 and 13146.3; and
WHEREAS, the City Council of the City of Carlsbad intends this resolution to fulfill the
requirements of the California Health & Safety Code regarding acknowledgment of the Carlsbad Fire
Department’s compliance with California Health and Safety Code Sections 13146.2 and 13146.3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.The proposed action is not a “project” as defined by California Environmental Quality
Act, or CEQA, Section 21065 and CEQA Guidelines Section 15378(b)(5) and does not
require environmental review under CEQA Guidelines Section 15060(c)(3) and
15061(b)(3), because the proposed action to report on annual fire inspection
compliance is an organizational or administrative government activity that does not
involve any commitment to any specific project which may result in a potentially
significant physical impact on the environment. Any subsequent action or direction
stemming from the proposed action may require the preparation of an environmental

A.EDUCATIONAL GROUP E OCCUPANCIES:
Educational Group E occupancies are generally those public and private schools,
used by more than six persons at any one time for educational purposes through the
12th grade. There are 38 Group E occupancy campuses within the City of Carlsbad.
During fiscal year 2025-26, the Carlsbad Fire Department completed the annual
inspection of 38 Group E occupancies, with a total building count of 271 structures
and/or facilities. This is a compliance rate of 100 percent for this reporting period.
B.RESIDENTIAL GROUP R OCCUPANCIES:
Residential Group R occupancies, for this resolution, are generally those
occupancies containing sleeping units and include hotels, motels, apartments (three
units or more), and other residential occupancies. There are 2,367 Group R (and their
associated sub-categories) occupancies within the City of Carlsbad.
During fiscal year 2025-26, the Carlsbad Fire Department completed the annual
inspection of 2,367 Group R occupancies, buildings, structures and facilities. This is a
compliance rate of 100 percent for this reporting period.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City
of Carlsbad on the 16th day of June, 2026, by the following vote, to wit:
