A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE FISCAL YEAR 2026-27 CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GENERAL PLAN AND APPLICABLE CLIMATE ACTION PLAN MEASURES AND ACTIONS WHEREAS, the City Council of the City of Carlsbad, California, has reviewed the Capital Improvement Program for fiscal year (FY) 2026-27 and has held such public hearings as are necessary prior to adoption of the Capital Improvement Program; and WHEREAS, on June 16, 2026, the City Council reviewed for consistency with the General Plan goals and policies all Capital projects receiving an allocation of funds for FY 2026-27 pursuant to Carlsbad Municipal Code Section 2.24.040(B); and WHEREAS, the City Council also reviewed the FY 2026-27 Capital Improvement Program projects for consistency with applicable Climate Action Plan measures and actions; and WHEREAS, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the City Council considered all factors relating to the City Council determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2. That the proposed action is not a “project” as defined by California Environmental Quality Act, or CEQA, Section 21065 and CEQA Guidelines Section 15378(b)(4) and does not require environmental review under CEQA Guidelines Section 15060(c)(3) as it is a government fiscal activity and does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. The activity or projects in the Capital Improvement Program may require preparation of an environmental document in accordance with CEQA and the CEQA Guidelines. 3.That based on the evidence presented at the hearing, the City Council determines that the Capital Improvement Program for FY 2026-27 is consistent with the General Plan based on the following findings: a.The projects are consistent with the goals and policies of the city’s General Plan in that the projects are required to ensure the provision of adequate public facilities and services concurrent with or prior to need. June 16, 2026 Item #6 Page 455 of 618 Docusign Envelope ID: EC574C28-EE41-8112-82BD-B665E154CC26 b.The projects are consistent with applicable goals and policies of the Arts, History, Culture, and Education; Land Use and Community Design; Mobility; Public Safety; and Sustainability Elements, as described in Attachment A. c.Specific projects are consistent with, and support Climate Action Plan greenhouse gas reduction measures and actions, if applicable, as described in Attachment A. d.As required by the General Plan, the proposed improvements are consistent with the city’s Growth Management Plan in that the projects ensure that the necessary improvements are provided for facilities maintenance, park development, recycled water, sewer and storm drain projects, and circulation systems, in accordance with the performance standards contained in the city’s Growth Management regulations. 4.This action is final as of the date this resolution is adopted by the City Council. The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, “Time Limits for Judicial Review” shall apply: “NOTICE” The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other action seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, CA 92008. Project Need Lift station upgrades are needed to replace aging facilities and electrical controls, and to accommodate anticipated development expansion in the area in accordance with current city standards. General Plan Consistency Goal 2-G.2 of the Land Use and Community Design Element: Promote a diversity of compatible land uses throughout the city…and public support systems such as…utilities. Goal 2-G.21 of the Land Use and Community Design Element: Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents. Policy 6-P.73 of the Public Safety Element: Ensure all new development complies with all applicable regulations regarding the provision of public utilities and facilities. Climate Action Plan Consistency This project is consistent with Climate Action Plan Measure W-1 (Wastewater System Improvements). Anticipated Environmental Review The level of environmental review and any potential environmental impacts will be determined upon further analysis. Depending on site conditions, the extent of work, and scope of work, the environmental review could range from a CEQA exemption (project is exempt from environmental review) to a Mitigated Negative Declaration (project has environmental impacts that can be mitigated). Project Need Carlsbad engineering standards require sewer lift stations to have dual force mains. The Chinquapin Lift Station currently only has one force main and requires an additional outfall to fulfill the operational redundancy requirements of the engineering standards. Project Need The project is needed to redirect sewer flow from Chinquapin Sewer Lift Station to the Vista-Carlsbad Sewer Interceptor to mitigate downstream impacts. General Plan Consistency Goal 2-G.2 of the Land Use and Community Design Element: Promote a diversity of compatible land uses throughout the city…and public support systems such as…utilities. Goal 2-G.21 of the Land Use and Community Design Element: Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents. Policy 6-P.73 of the Public Safety Element: Ensure all new development complies with all applicable regulations regarding the provision of public utilities and facilities. Climate Action Plan Consistency This project is consistent with Climate Action Plan Measure W-1 (Wastewater System Improvements). Anticipated Environmental Review The level of environmental review and any potential environmental impacts will be determined upon further analysis. Based on preliminary information, the project is intended to redirect existing sewer flow rather than expand capacity, and may qualify for a categorical exemption under CEQA Guidelines Section 15301. However, depending on site conditions, the extent of work, and scope of work, the environmental review could range from a CEQA exemption (project is exempt from environmental review) to a Mitigated Negative Declaration (project has environmental impacts that can be mitigated). Project Need The central plant is at the end of its useful life and needs replacement. General Plan Consistency Policy 7-P.24 of the Arts, History, Culture, and Education Element: Provide adequate library facilities and programs that align with the community’s learning needs, abilities and demographics, and changes in technology, such as through facility design, services and service delivery methods, and partnerships with educational and learning institutions. Climate Action Plan Consistency At the time of review, staff were not aware what type of equipment would be used to replace the central plant. Action E-1.c in the Climate Action Plan is to “eliminate natural gas at city facilities, where feasible.” This should be kept in mind as staff move forward with this effort. Anticipated Environmental Review The proposed action for refurbishment of the existing central plant at Dove Library is likely categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair, or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) are likely to apply. Project Need The project will make the stairs safer with flat stones instead of the current uneven rocks and raised "red carpet." General Plan Consistency Goal 4-G.6 of the Open Space, Conservation, and Recreation Element: Offer a wide variety of recreational activities and park facilities designed to encourage educational benefits and active or passive participation by users of all ages and interests Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The proposed action for replacement of existing staircases at Leo Carrillo Ranch Historic Park may qualify for a categorical exemption from environmental review under CEQA Guidelines Section 15301; however, prior to any discretionary action, a determination must be made as to whether the project would cause a substantial adverse change in the significance of a historical resource pursuant to CEQA Guidelines Section 15064.5. If the project is found to have no adverse effect on the historic resource, a categorical exemption may apply. If an adverse effect is identified, additional environmental review will be required. Project Need Water system improvements to the distribution system will be identified in the Water Master Plan update and ongoing system optimization evaluations.
