SUBJECT: CDP 04-60 -MULLINS REMODEL -Request for approval of a Coastal
Development Permit to partially demolish and allow for the
redevelopment/rehabilitation of an existing single-family residence on a 3, 141
square foot lot located at 2445 Mountain View Drive between Pacific A venue and
Normandy Lane within the Mello II Segment of the Local Coastal Program (LCP)
and Local Facilities Management Zone 1.
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5991
APPROVING Coastal Development Permit CDP 04-60 based upon findings and subject to the
conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.201.030 of the Carlsbad Municipal Code, the
redevelopment/rehabilitation of an existing residence removing greater than 50% of the exterior
walls within the City's Coastal Zone requires the processing and approval of a Coastal
Development Permit (CDP). The CDP application was reviewed for consistency with Local
Coastal Program (LCP) land use plan policies and implementation standards. The proposed
residence is consistent with the Mello II Segment of the City's LCP. There are no unresolved
issues. The staff recommendation for approval with conditions is supported by the analysis as
follows.
III. PROJECT DESCRIPTION AND BACKGROUND
Project Site/Setting: The 3,141 square foot lot is located at 2445 Mountain View Drive between
Pacific A venue and Normandy Lane as shown on the attached location map. Topographically,
the lot is mostly flat with a gentle slope downward from west to east and is currently developed
with a one story single-family residence. The lot is not located in the appeals jurisdiction of the
California Coastal Commission. The existing structure, a single-family dwelling, is to be
partially demolished to allow the redevelopment/rehabilitation of the property into a newer
custom home.
Proposed Residential Construction: The applicant is proposing to remodel an older existing
single-family residence into a two-story single-family residence with attached two-car garage.
When completed, the rehabilitated residence will have a total of 2,052 square feet of living area
and 414 square feet of garage area. The "French" style structure will be constructed of a wood
frame with a stucco finish and a decorative tile roof.

Proposed Grading: A grading permit will not be required for this project.
Impact on Coastal Resources: The development consists of the redevelopment/rehabilitation of
an older existing one story single-family residence on a previously developed lot; no agricultural
activities, sensitive resources, geological instability, flood hazard or coastal access opportunities
exist onsite and the development does not obstruct views of the coastline as seen from public
lands or public right-of-way or otherwise damage the visual beauty of the coastal zone.
IV. ANALYSIS
As shown on the Coastal Development Compliance Table below, the proposed development is in
compliance with all applicable regulations. Building permits may be issued subject to the
conditions contained in Planning Commission Resolution No. 5991.

Review of Required Coastal Findings
1. Conforman~e with the Certified Local Coastal Program and all applicable policies.
The project is located in the Mello II Local Coastal Program Segment.
The project proposes to rehabilitate and expand an older existing single story residence
into a 2,052 square foot two-story single-family residence with a two-car garage in an
area designated for single-family and multi-family development. The subject site has an
LCP Land Use Plan designation ofRMH (Residential Medium High Density; 9-15 du/ac)
which allows for 11.5 dwelling units per acre at the Growth Management Control Point.
Based on the 11.5 units per acre, the lot could accommodate one dwelling unit.
The proposed residence will be located on the west side of Mountain View Drive
between Pacific Avenue and Normandy Lane. The two-story single-family residence will
be consistent with the surrounding development of one and two-story single-family and

multi-family structures. The two-story structure will not obstruct views of the coastline
as seen from public lands or the public right-of-way, nor otherwise damage the visual
beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there
any sensitive resources located on the property. The rehabilitated residence is not located
in an area of known geologic instability or flood hazard. No public opportunities for
coastal shoreline access are available from the subject site since it is not located between
the first public road and the ocean, and no public access requirements are conditioned for
the project. The residentially designated site is not suited for water-oriented recreation
activities.
Conformance with public access and recreation policies of Chapter 3 of the Coastal Act.
The subject site is located in the Coastal Resource Protection Overlay Zone. However,
due to its location and the absence of slopes equal to or steeper than 25% inclination
and/or native vegetation, additional submittals, standards or requirements do not apply.
City Council Policy 44 -Neighborhood Architectural Design Guidelines
Single-family home remodels that cumulatively increase the useable living area (floor area) more
than 40% shall comply with numbers 7 and 13 of the City's Neighborhood Architectural Design
Guidelines. These guidelines require recessed or projected doors and windows, and specific
architectural design elements. The proposed remodel of the existing single-family residence
satisfies all of the required Neighborhood Architectural Design Guidelines as shown in the table
below. Only the items noted in the table are required for the remodel/expansion of an existing
individual single-family residence.

V. ENVIRONMENTAL REVIEW
The project is exempt from CEQA per the exemptions listed below:
(1) Section 15301(1)(1) of CEQA Guidelines (Class 1) exempts the demolition of
single-family residences.
(2) Section 15303(a) of CEQA exemptions (Class 3) exempts the construction of
single-family residences in an urbanized area from environmental review.
A Notice of Exemption will be filed by the Planning Director upon project approval.
