I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 6175, 6176, 6177 and 6178 APPROVING Site Development Plan (SDP 05-17), Hillside Development Permit (HDP 05-13), Coastal Development Permit (CDP 05-52), and Condominium Permit (CP 06-11) based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The proposal involves the demolition of an existing single family home and the subdivision and construction of two (2) residential air-space condominiums on a .43-acre site. The proposed project would include a two-story building with private recreational areas. A Site Development Plan (SDP) is required since the project is located in the Beach Area Overlay Zone (BAOZ) and a Condominium Permit (CP) is required to allow an air-space condominium subdivision. The project is an infill project surrounded by the Army-Navy Academy and a mix of single-family and multi-family developments and is exempt from environmental review. The project is located in the coastal zone and is subject to the Mello II Segment of the Local Coastal Program and approval of a Coastal Development• Permit (CDP), which is appealable to the California Coastal Commission. A Hillside Development Permit (HDP) is required as the project site contains slopes exceeding 15-percent and slope elevation differences greater than 15 feet. Since the project is only two units, the Engineering Department will be administratively processing a Minor Subdivision (MS 05-31) subsequent to the Planning Commission's action on this project. The project also required an Administrative Variance (AV 05-06) to reduce the front yard setback from 20-feet to 12-feet. The Administrative Variance was approved by the Planning Director on September 27, 2006. The project meets all applicable regulations and staff has no issues with the proposal. III. PROJECT DESCRIPTION AND BACKGROUND The applicant is requesting to demolish one single-family dwelling and develop two (2) residential air-space condominiums. The 0.43-acre site is located west of Ocean Street and {'. .... SDP 05-17/HDP 05-13/CDP 0!2/CP 06-11-DONALD CONDOMnlMs October 18, 2006 Pae 2 North of Pacific Avenue within the Mello II Segment of the Local Coastal Program and in Local Facilities Management Zone 1. The site has a Residential Medium-High Density (RMH) General Plan Land Use designation and is zoned Multiple-Family Residential (R-3). The project site is surrounded by single family to the north, the Army-Navy Academy to the south, multifamily residential to the east, and the Pacific Ocean to the west. The proposed development would consist of a two-story structure with a basement. Each unit will have a 2-car garage with direct access to each of the units. The one required visitor parking space will be provided in a covered parking bay. The units are 3,830 square feet and 4,643 square feet in size. Each unit has a separate exterior pedestrian entrance, private rear yard patios and decks, and private storage space in the basement. The building will have concrete plaster coated walls with an extensive use of windows and architectural elements of wrought-iron. The project will take access off of Ocean Street and will be required to enter into a Neighborhood Improvement Agreement (NIA), because Ocean Street is designated as an Alternative Design Street. Approximately 2,140 cubic yards of cut would be necessary to prepare for the basement, with 80 cubic yards to be exported from the site. Runoff from the site would be treated with drainage swales along the rear of the property in compliance with the City's National Pollutant Discharge Elimination System Permit. IV. ANALYSIS The project is subject to the following regulations: A. General Plan Residential Medium-High Density (RMH) Land Use designation; B. Coastal Development Regulations for the Mello II Local Coastal Program (LCP) Segment, Coastal Resource Protection Overlay Zone and the Coastal Shoreline Development Overlay Zone (Chapters 21.201, 21.203 and 21.204 of the Zoning Ordinance); C. Multiple-Family Residential Zone (R-3; Chapter 21.16 of the Zoning Ordinance), Beach Area Overlay Zone (BAOZ; Chapter 21.82 of the Zoning Ordinance), and Planned Development Ordinance (Chapter 21.45 of the Zoning Ordinance); D. City Council Policy No. 66 (Principals for the Development of Livable Neighborhoods); E. Hillside Development Regulations and Guidelines (Chapter 21.95); F. Subdivision Ordinance (Title 20 of the Carlsbad Municipal Code); G. Inclusionary Housing Ordinance (Chapter 21.85 of the Zoning Ordinance); H. Growth Management Ordinance (Chapter 21.90 of the Zoning Ordinance) and Zone 1 Local Facilities Management Plan. The recommendation for approval of this project was developed by analyzing the project's consistency with the applicable regulations and policies. The project's compliance with each of the above regulations is discussed in detail in the sections below. A. General Plan Residential Medium High Density (RMH) Land Use designation The General Plan Land Use designation for the property is Residential Medium-High (RMH). The RMH designation allows residential development at a density range of 8 -15 dwelling units SDP 05-17/HDP 05-13/CDP o!2/CP 06-11-DONALD CONDOMIN,MS October 18, 2006 Pae 3 per acre with a Growth Management Control Point (GMCP) of 11.5 dwelling units per acre. The project site has a net developable acreage of 0.17 acres. The project's proposed density of 11.76 du/ac (2 dwelling units) is within the RMH density range of 8 -15 du/ac, but is slightly above the RMH GMCP of 11.5 du/ac used for the purpose of calculating the City's compliance with Government Code Section 65863. At the GMCP, 1.95 dwelling units would be permitted on this 0.17 net developable acre property. Although the project exceeds the GMCP for the RMH General Plan Land Use designation by a fractional unit allocation of 0.05 dwelling units, the General Plan Land Use Element allows the City to approve residential development at a density that exceeds the GMCP for the applicable density range provided the proposed residential development complies with certain findings as discussed below. To exceed the GMCP, the project must be consistent with the following required General Plan findings: 1) that the project will provide sufficient additional public facilities for the density in excess of the control point to ensure that the adequacy of the City's public facilities plans will not be adversely impacted; 2) that there have been sufficient developments approved in the quadrant at densities below the control point so that the approval will not result in exceeding the quadrant limit; and, 3) all necessary public facilities required by the City's Growth Management Program will be constructed, or are guaranteed to be constructed, concurrently with the need for them created by this development and in compliance with the adopted City standards. The proposed project is consistent with the above required findings in that there have been sufficient developments in the northwest quadrant that have developed at densities below the GMCP such that the allocation of 0.05 DUs would not result in exceeding the quadrant limit, the project is conditioned to pay the appropriate fees to comply with City's Growth Management Program, and the City's public facilities plans will not be adversely impacted as the allocation of 0.05 units has already been analyzed and anticipated within the northwest quadrant. Coastal Development Regulations for the Mello II Local Coastal Program Segment, Coastal Resource Protection Overlay Zone and Coastal Shoreline Development Overlay Zone The project site is located within the appeal area of the Coastal Zone and within the Mello II Segment of the Local Coastal Program. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203) and the Coastal Shoreline Development Overlay Zone (Chapter 21.204) of the Carlsbad Municipal Code. The proposed project is consistent with the Mello II Segment of the LCP which contains land use policies for development and conservation of coastal land and water areas within its boundaries. The policies of the Mello II Segment emphasize topics such as preservation of agriculture and scenic resources, protection of environmentally sensitive resources, provision of shoreline access and prevention of geologic instability and erosion. The project is consistent with the Coastal Act policies as follows: A) no agricultural lands exist on the project site, therefore no impacts to such will occur; B) the site does not contain or impact environmentally sensitive habitats, water or marine resources; C) the site is geologically stable and the proposed grading for the site has been limited to the area necessary to develop the site; D) the project has been designed to reduce the amount of off-site runoff by use ofbio-swales and has been conditioned to implement the NPDES standards to ensure the quality of the water SDP 05-17 /HDP 05-13/CDP 0!2/CP 06-11-DONALD CONDOMIN,MS October 18, 2006 Pae 5 leaving the site; E) the project meets the parking requirements of the zoning ordinance; F) the project does not preclude any recreational opportunities or shoreline access as the property is currently developed with a single family home; and, G) the two proposed residential air-space condominiums will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. The project site is located in the Coastal Resource Protection Overlay Zone. This overlay zone allows development of steep slopes of 25% or greater that do not contain endangered plant/animal species and/or coastal sage scrub or chaparral plant communities, subject to specific findings. Hillside Development Regulation and Guidelines The project is subject to the Hillside Development Regulations because the site contains slopes over 15% and slope elevation differences greater than 15 feet. The steeper slopes traverse the site from northwest to southeast. The steep slope area is roughly 568 square feet in area with a slope gradient of 40% or greater. The development complies with the ordinance and the Hillside Guidelines as follows: the proposed project is: a) consistent with the Land Use and Open Space/Conservation Elements of the General Plan since the site has been previously graded and developed, there exist no natural hillsides, and the project site has no value as habitat for endangered, rare or threatened species, b) the project design minimizes the amount of grading to an acceptable quantity of 4,976 cubic yards per acre, will incorporate an aesthetically pleasing design with landscaping, and retaining/planting walls will be developed primarily on the perimeter of the site and the new 2- unit condominium will be developed in approximately the same location as the existing building; c) the existing hillside is manufactured and accordingly, there will be no impacts to natural slope SDP 05-17 /HDP 05-13/CDP 0!2/CP 06-11-DONALD CONDOMIN,MS October 18, 2006 Pa e 11 or resource areas, wildlife habitats or native vegetation; d) there will be no impact on lagoons or riparian ecosystems in that the project has been conditioned to submit an erosion control plan consistent with the NPDES permit requirements as required by the Regional Water Quality Control Board and the City of Carlsbad. F. Subdivision Map Act The Engineering Department has reviewed the proposed Minor Subdivision and is of the opinion that the subdivision complies with all applicable requirements of the Subdivision Map Act and the City's Subdivision Ordinance. The Engineering Department will take action on the Minor Subdivision subsequent to the Planning Commission's action on the SDP, HDP, CDP, and CP. The project is conditioned to install all infrastructure improvements concurrent with development. The proposed building setbacks will allow for adequate air circulation and the opportunity for passive heating and cooling. G. Inclusionary Housing Ordinance For all residential developments less than seven units, the inclusionary requirement may be satisfied through the payment of an inclusionary housing in-lieu fee. The project has been conditioned to pay the fee prior to building permit issuance. H. Growth Management Regulations The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of the City. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in the table below. The maximum unit yield of the property is 1.95 dwelling units at the City's GMCP. Pursuant to City Council Policy No. 43, the project "qualifies" for a 0.05 dwelling unit allocation from the excess dwelling unit bank as the project dwelling unit yield at the GMCP for the property results in a unit yield that includes a fractional unit of 0.5 or greater (1.95 DUs).
