AGENDA OF: June 7, 2006 ItemNo. G) Application complete date: December 21, 2005 Project Planner: Greg Fisher Project Engineer: Bob Wojcik SUBJECT: CDP 05-38 -BAGNALL RESIDENCE -Request for approval of a Coastal Development Permit to allow for the addition of 1,633 square-feet of first and second floor living area to an existing single-family residence located at 5029 Tierra Del Oro Street within the Mello II Segment of the Local Coastal Program (LCP) and Local Facilities Management Zone 3. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 6081 APPROVING Coastal Development Permit CDP 05-38 based upon findings and subject to the conditions contained therein. II. INTRODUCTION Pursuant to Section 21.201.060 of the Carlsbad Municipal Code, improvements to a single family residence where the residence or proposed improvements would encroach within fifty feet of the edge of a coastal bluff within the City's Coastal Zone requires the processing and approval of a Coastal Development Permit (CDP). The CDP application was reviewed for consistency with Local Coastal Program (LCP) Land Use Plan policies and Implementation Plan Standards. The proposed residence is consistent with the Mello II Segment of the City's LCP. There are no unresolved issues. The staff recommendation for approval with conditions is supported by the analysis as follows. III. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: The .37-acre (16,221 square foot) developed lot is located on the west side of Tierra Del Oro Street at 5029 Tierra Del Oro Street as shown on the attached location map. Topographically, from east to west, the relatively flat lot transitions into a moderately steep coastal bluff slope. The eastern half of the site is currently developed with a one-story single family residence. The western half of the lot includes hardscape (patio area) in addition to rip rap erosion prevention at the toe of slope. The lot is located within the appeal area of the Mello II Segment of the Coastal Zone and any final decision of the City of Carlsbad is appealable to or by the California Coastal Commission. Proposed Residential Construction: The applicant is proposing to construct 1,633 square-feet of first and second floor living area additions to an existing single-family residence. When completed, the residence will have a total of 3,686 square feet of living area. The structures exterior will be finished with cedar shingle and stucco siding and a decorative metal roof. The project must comply with City Council Policy 44 -Neighborhood Architectural Design if'. "•+' CDP 05-38 -BAGNALL RES,NCE June 7, 2006 Page 2 Guidelines because the proposed addition increases the useable living area by more than 40% (see compliance discussion below). Proposed Grading: No grading is proposed for this project. Impact on Coastal Resources: The development is an addition to an existing one-story, single family residence on a previously developed lot; no agricultural activities, sensitive resources, geological instability, flood hazard or vertical coastal access opportunities exist onsite and the development does not obstruct views of the coastline as seen from public lands or public right of-way or otherwise damage the visual beauty of the coastal zone. IV. ANALYSIS As shown on the Coastal Development Compliance Table below, the proposed development is in compliance with all applicable regulations. Building permits may be issued subject to the conditions contained in Planning Commission Resolution No. 6081. Review of Required Coastal Findings 1. Conformance with the Certified Local Coastal Program and all applicable policies. The project is located in the Mello II Segment of the Local Coastal Program. The project proposes an addition to an existing one-story, single-family residence in an area designated for single-family development. The subject site has an LCP Land Use Plan designation of RLM/OS (Residential Low-Medium and Open Space; 0-4.0 du/ac), which allows for 3.2 dwelling units per acre at the Growth Management Control Point. The OS CDP 05-38 -BAGNALL RESIINCE June 7, 2006 Page 3 General Plan Land Use designation applies to the coastal bluff portion of the site and no development is proposed within this area. The proposed addition to the existing single family residence is consistent with the land use type and density regulations for the property. The proposed addition to the one-story, single-family residence would be consistent with the surrounding development of one and two-story single-family structures. The two story structure will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the previously developed site, nor are there any sensitive resources located on the property. The proposed addition to the existing residence is not located in an area of known geologic instability or flood hazard. No public opportunities for vertical coastal shoreline access are available from the subject site, and no public access requirements are conditioned for the project. The residentially designated site is not suited for water-oriented recreation activities. 2. Conformance with public access and recreation policies of Chapter 3 of the Coastal Act. 3. The property is located adjacent to the shore, however, there are no opportunities for vertical coastal access or recreational activities from the subject site. There are existing public beach access points located to the north and south of the site and a private beach access for Terra Mar residents available on Shore Drive, just to the south of the project site. Therefore, the project will not interfere with the public's right to physical access to the sea. Coastal Overlay Zones. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run off, pollutants and soil erosion. No development is proposed in areas of steep slopes ( coastal bluff) and no native vegetation is located on the subject property. The site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. In addition, the project is consistent with the provisions of the Coastal Shoreline Development Overlay Zone (Chapter 21.204 of the Zoning Ordinance) in that the project has been conditioned to provide the public with the right of lateral access to a minimum of twenty-five feet of dry sandy beach at all times of the year. The new second story addition will be consistent with the stringline provisions as the proposed addition will not encroach west of the existing residence which is parallel to the adjacent properties to the north and south and will not be adjacent to any steep slopes. City Council Policy 44 -Neighborhood Architectural Design Guidelines Single-family home remodels that cumulatively increase the useable living area (floor area) more than 40% shall comply with Guideline Nos. 7, 13 and 14 of the City's Neighborhood Architectural Design Guidelines. These guidelines require recessed or projected doors and CDP 05-38 -BAGNALL RES.NCE June 7, 2006 Page 4 windows, and specific architectural design elements. The proposed addition to the existing single-family residence satisfies all of the required Neighborhood Architectural Design Guidelines as shown in the Table below.
