Executive Summary TransNet is the half-percent countywide sales tax for local transportation projects approved by voters in 1987 and extended for an additional 40 years in 2004. To use TransNet funds for local transportation projects, cities and other San Diego Association of Governments, member agencies must approve their programs of projects every two years. These programs are then incorporated into the Regional Transportation Improvement Program, which includes proposed TransNet-funded highway, arterial roadway, transit and bikeway projects for the entire county. In addition to projects using TransNet funds, each agency’s program of projects must also include transportation projects that have state or federal funding and those that are regionally significant and increase transportation capacity, regardless of their funding sources. To obtain TransNet funding, the City Council must hold a public hearing to consider and approve the city’s program of projects. The signed resolution in Exhibit 1, which includes the list of projects in Attachment A to the exhibit and approves the program, is due to the San Diego Association of Governments by July 1, 2026. The city’s program will then be incorporated into SANDAG’s 2027 Regional Transportation Improvement Program. June 23, 2026 Item #12 Page 1 of 12 Docusign Envelope ID: 0C3D1534-B206-8267-80A7-041D82D16A04 Explanation & Analysis Background SANDAG, acting as the Regional Transportation Commission, is required by state and federal laws to develop and adopt an updated regional program every two years. In addition to the federal and state requirements, the TransNet Extension Ordinance requires SANDAG to prepare a five-year TransNet program of projects every two years. Each member agency of SANDAG that wants to spend TransNet and certain federal or state funds must approve its own program of projects every two years. In addition to the projects using those funding sources, the program must include projects that will increase transportation capacity, regardless of their funding sources. The federal Metropolitan Planning and Air Quality Conformity Regulations also require the program includes all capacity-increasing road projects for air quality emissions modeling and analysis. The City Council approved the city’s 2025 TransNet Local Street Improvement Program of Projects on June 18, 2024, which covered a five-year program through fiscal year 2028-29. This year’s update As part of the FY 2026-27 Capital Improvement Program budget development process, staff have identified several transportation projects that will use TransNet, state and/or federal funding. These are reflected in the city’s proposed five-year Program of Projects to be included in the regionwide 2027 Regional Transportation Improvement Program. The SANDAG Board of Directors, acting as the San Diego County Regional Transportation Commission, approves the TransNet Program of Projects as an element of the 2027 Regional Transportation Improvement Program, which is scheduled for consideration on Sept. 25, 2026. City of Carlsbad’s proposed Program of Projects The proposed City of Carlsbad Program of Projects for FYs 2026-27 through 2030-31, which is shown in Exhibit 1, Attachment A, includes projects with the following funding sources: •Federal funds – administered by the California Department of Transportation •TransNet Local Street Improvement Funds – administered by SANDAG •Local funds from the city’s funds, including traffic impact fees and gas tax •Local funds from developers TransNet local funds are programmed for a variety of projects, including Americans with Disabilities Act improvements, various roadway improvements, the pavement management program, traffic signal improvements and roadway lighting projects. The city’s Program of Projects also includes various capacity-increasing roadway projects along regionally significant arterial roadways, regardless of the funding source. Some of these projects are funded by city funds such as traffic impact fees or funding from adjacent private development. The program may be amended as needed on a quarterly basis during the two-year period and may require the City Council’s approval before submittal to SANDAG to process the amendment request. June 23, 2026 Item #12 Page 2 of 12 Docusign Envelope ID: 0C3D1534-B206-8267-80A7-041D82D16A04 Funding requirements The TransNet Extension Ordinance places certain requirements on local jurisdictions regarding the use of TransNet funds: •No more than 30% of cumulative TransNet revenues shall be spent on local street and road maintenance projects. •All new projects or major reconstruction projects funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists. Any deviation from this requirement shall be clearly noticed as part of that local jurisdiction’s public hearing process. •The required minimum annual level of local discretionary funds to be spent on streets and roads will be met throughout the five-year period consistent with the most recent maintenance of effort requirements adopted by SANDAG. •Local jurisdictions must collect an amount equivalent to $3,109.88, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in that jurisdiction, unless exempted under the 2004 TransNet Extension Ordinance, and shall contribute these funds to the Regional Transportation Congestion Improvement Program. •Local jurisdictions must establish a separate transportation improvement account for TransNet revenues with the interest earned spent only for those purposes for which the funds were allocated. •Each project of $250,000 or more will be clearly designated during construction with TransNet project funding identification signs. Fiscal Analysis Being included in SANDAG’s regional program is not a guarantee that projects will receive the stated funding. The amounts shown in Attachment A to Exhibit 1 are the best available estimates of project costs and anticipated funding. The city is not obligated to proceed with the projects included in the city’s Program of Projects if funding falls short or is not available. Next Steps Upon approval by the City Council, staff will submit the city’s Program of Projects and signed resolution to SANDAG for inclusion in the 2027 Regional Transportation Improvement Program by the due date of July 1, 2026. The 2027 Regional Transportation Improvement Program is expected to be adopted by the SANDAG Board of Directors on Sept. 25, 2026, and is anticipated to receive federal approval in December 2026. Environmental Evaluation The proposed action is not a “project” as defined by California Environmental Quality Act, or CEQA, Section 21065 and CEQA Guidelines Section 15378(b)(4) and does not require environmental review under CEQA Guidelines Section 15060(c)(3) because it is a government fiscal activity and does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. The activity or projects which this budget is intended to fund may require preparation of an environmental document in accordance with CEQA and CEQA Guidelines. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE CARLSBAD TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2026-27 THROUGH 2030-31 FOR INCLUSION IN THE 2027 SAN DIEGO ASSOCIATION OF GOVERNMENTS REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM WHEREAS, on Nov. 4, 2004, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan, or TransNet Extension Ordinance, which has been amended from time to time in accordance with the applicable amendment requirements; and WHEREAS, the TransNet Extension Ordinance provides that the San Diego Association of Governments, or SANDAG, acting as the Regional Transportation Commission, shall approve every two years a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (i.e., TransNet) funds; and WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local street improvement revenues for fiscal years 2026-27 through 2030-31; and WHEREAS, on June 23, 2026, the City of Carlsbad held a noticed public hearing with an agenda item that clearly identified the proposed list of projects in the notice and as Attachment A to this resolution, prior to approval of the projects by its authorized legislative body, which is the City Council, in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31; and WHEREAS, Rule 15 of SANDAG Board Policy No. 31 requires each local agency to hold harmless the Regional Transportation Commission against challenges related to the city’s TransNet projects. The activity or projects which this budget is intended to fund may require preparation of an environmental document in accordance with CEQA and CEQA Guidelines. 3.That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of Carlsbad certifies that no more than 30% of its cumulative revenues shall be spent on local street and road maintenance-related projects, or that its expenditures are consistent with the most recent TransNet Extension Ordinance requirements adopted by SANDAG. 4.That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Carlsbad’s public hearing process. 5.That pursuant to Section 8 of the TransNet Extension Ordinance, the City of Carlsbad certifies that the required minimum annual level of local discretionary funds to be expended for street and road purposes will be met throughout the five-year period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. 6.That pursuant to Section 9A of the TransNet Extension Ordinance, the City of Carlsbad certifies that it will exact an amount equivalent to $3,109.88, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in the City of Carlsbad, unless exempted under the TransNet Extension Ordinance, and shall contribute such exactions to the Regional Transportation Congestion Improvement Program, or RTCIP. 7.That pursuant to Section 13 of the TransNet Extension Ordinance, the City of Carlsbad certifies that it has established a separate Transportation Improvement Account for TransNet revenues with interest earned expended only for those purposes for which the funds were allocated.
