Dear Mr. Mozga: The Land Use Planning Manager has completed a review of your a p p l i c a t i o n for an administrative variance at 2361 Spruce Street. After careful consideration of the circumstances surrounding t h i s request, the Land Use Planning Manager has determined that the four findings required for granting an administrative variance can be made and, therefore, approves t h i s request based on the following findings and conditions. Findings: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of u s e i n t h e same v i c i n i t y and zone, because the property is d i f f i c u l t to develop due to the topographic i r r e g u l a r i t y of the lot. A steep slope limits t h e buildable area to only t h e front half of t h e lot. 2. The requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in t h e same v i c i n i t y and zone b u t which is denied to the property in question because other properties i n t h e vicinity have the same s i t u a t i o n i n their rear yards and have reduced front yard setbacks. The granting of t h i s variance w i l l not be materially detrimental to t h e public welfare or i n j u r i o u s to the property or improvements in the vicinity and zone i n which t h e property is located since the proposed front setback w i l l be similar with other residential front yard setbacks i n t h e v i c i n i t y . 4 . The granting of this variance w i l l not adversely affect the comprehensive general plan because t h e granting of this variance w i l l not alter the single family use of t h e property as intended by the Residential Low Medium Density designation of t h e General Plan.
