SUBJECT: Administrative Variance No. 85-8 -Request to allow a
six foot high fence to encroach eleven feet within the
twenty foot front yard setback on a lot located on the
north side of Juniper Street between Garfield Street
and the AT&SF Railroad.
Dear Ms. Beilbey::
The Land Use Planning Manager has completed a review of your
application for an administrative variance at 252 Juniper
Street, Apartment A-2. After careful consideration of the
circumstances surrounding this request, the Land Use Planning
Manager has determined that the four findings required for
granting an administrative variance cannot be made and,
therefore, denies this request based on the following findings:
Findings:
1. There are no exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use
that do not apply generally to the other property or class of
use in the same vicinity and zone, because no other fences
six feet or higher are located more than five feet into the
20 foot front yard setback.
2. The requested variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by
other property in the same vicinity and zone but which is
denied to the property in question because no other property
owner in the complex has had to fence in their yard for
privacy.
3) The granting of this variance might be materially
detrimental to the public welfare since it would create an
undesirable prec~dent.
