HomeMy WebLinkAbout2026-07-07; City Council; Resolution 2026-145Exhibit 2 RESOLUTION NO. 2026-145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AN AMENDMENT TO EXTEND THE PROFESSIONAL SERVICES AGREEMENT WITH COMMUNITY RESOURCE CENTER TO PROVIDE RAPID RE-HOUSING SERVICES FOR FISCAL YEAR 2026-27 WHEREAS, Community Resource Center has operated the city’s rapid re-housing program since July 1, 2020, under a professional services agreement; and WHEREAS, on June 24, 2025, the City Council of the City of Carlsbad, California approved an amendment to the professional services agreement with Community Resource Center to provide rapid re-housing services; and WHEREAS, on May 27, 2026, the city received a renewal award from the U.S. Department of Housing and Urban Development Continuum of Care Program for rapid re-housing assistance and case management in the amount of $1,185,510; and WHEREAS, the City Council of the City of Carlsbad, California approved the city’s Homelessness Action Plan on Feb. 7, 2023; and WHEREAS, the Homelessness Action Plan identifies Housing and Shelter as one of three areas of focus; and WHEREAS, on June 16, 2026, the City Council of the City of Carlsbad approved the Fiscal Year 2026-27 Operating Budget, which included acceptance of the HUD Continuum of Care funds and an allocation of $175,000 from the city’s General Fund for rapid re-housing; and WHEREAS, staff intends to utilize $1,142,745 of the HUD funds and $175,000 from the city’s General Fund for a professional services agreement amendment in an amount not to exceed $1,317,745 with Community Resource Center for rapid re-housing assistance and case management services consistent with the city’s Homelessness Action Plan; and WHEREAS, the extension of the professional services agreement with Community Resource Center requires City Council approval of an amendment to the agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. July 7, 2026 Item #8 Page 26 of 32 Docusign Envelope ID: 149C1139-675A-86A7-8160-A4413C84F593 2.The proposed action is not a “project” as defined by California Environmental Quality Act, or CEQA, Section 21065 and CEQA Guidelines Section 15378(a) and does not require environmental review under CEQA Guidelines Section 15060(c)(2) because the action is limited to the execution of agreements to provide medium term rental assistance and supportive services to people who were previously experiencing homelessness. The action has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. 3.That the City Manager or designee is hereby authorized to execute the amendment to the professional services agreement between the City of Carlsbad and Community Resource Center for rapid re-housing assistance and case management services for Fiscal Year 2026-27, in an amount not to exceed $1,317,745, attached as Attachment A. 4.That the City Manager, or designee, is further authorized to execute any related documents and take all actions necessary to implement and administer the agreement amendment, subject to compliance with the terms and conditions of the agreement and applicable law. RECITALS A.On January 11, 2022, the City Council adopted Resolution No. 2022-007, authorizing the Agreement with Community Resource Center; and B.On June 20, 2023, the City Council adopted Resolution No. 2023-175 authorizing Amendment 1 to the Agreement, and on June 21, 2023, and the Parties executed Amendment No. 1 to the Agreement to extend the term and amend the scope of services and budget; and C.On June 25, 2024, the Parties executed Amendment No. 2 to the Agreement to extend the term, amend the scope of services and budget, and update the Indemnification Clause of the Agreement; and D.On June 24, 2025, the City Council adopted Resolution No. 2025-149 authorizing an amendment and extension to the Agreement, and the Parties untimely executed Amendment No. 3 to extend the term and amend the scope of services on July 2, 2025; and E.On September 2, 2025, the Parties executed Amendment No. 4 to ratify Amendment No. 3 and to retroactively extend and amend the Agreement effective June 30, 2025; and F.The Parties now desire with this Amendment to amend the Agreement’s budget and compensation, extend the term, and comply with the terms of the city’s grant agreement under federal grant number CA2170L9D012503 once fully executed; and G.The Parties have negotiated and agreed to the terms of this Amendment. That the Agreement, as may have been amended from time to time, is hereby extended for a period of one (1) year. The term of this Agreement is now effective until June 30, 2027. The extension of the Agreement’s term, with this Amendment, commences on July 1, 2026. 2. With this Amendment, the Agreement compensation amount per year shall not exceed one million, three hundred seventeen thousand, seven hundred and forty-five dollars ($1,317,745.00); and the total Agreement compensation amount shall not exceed four million, eight hundred ninety thousand, nine hundred and fifty-one dollars ($4,890,951). 3. The Parties have agreed to abide by the terms and conditions contained within the Continuum of Care Program Grant Agreement, incorporated by this reference and attached as Exhibit “D-1”. 4. The budget contained in the Agreement is deleted in its entirety and replaced with the Budget contained in the attached Exhibit “C-7” and incorporated by this reference. 5. All other provisions of this Agreement, as may have been amended from time to time, will remain in full force and effect. 6. All requisite insurance policies to be maintained by Contractor pursuant to this Agreement, as may have been amended from time to time, will include coverage for this Amendment.
