Executive Summary The City of Carlsbad conducts an annual Hazard Reduction Program to eliminate fire hazards and nuisances caused by the accumulation of dry weeds and rubbish on vacant lots throughout the city. The City Council may declare weeds, rubbish and refuse on private property as public nuisances, as authorized by California Government Code Sections 39560-39588. This report is the third and final report for the 2026 Hazard Reduction Program, covering the program’s annual results. Staff recommend approval of the Hazard Reduction Cost Report. Explanation & Analysis The Carlsbad Fire Department has completed its annual hazard survey, identifying 221 parcels that have, or are likely to have, potential hazards during the drier months when the risk of fire increases. The City Council declared these parcels public nuisances on March 24, 2026. Following the City Council’s action, the Fire Department and City Clerk mailed notices to property owners on March 25, 2026. Property owners were informed that any nuisances existing after May 15, 2026, would be subject to removal by the city, and that costs related to the abatement of these nuisances would be forwarded to the San Diego County Tax Assessor for inclusion on their property tax bills. •Thirty parcels were not cleared by the property owners by the May 15, 2026, deadline. The city’s contractor subsequently performed weed abatement services on these parcels. The contractor’s fee for this work totals $32,980. July 21, 2026 Item #6 Page 1 of 9 Docusign Envelope ID: B98B8EC9-AC5E-8F6D-8030-31BAA812C40D •Each property owner will be billed for the abatement services performed on their property, along with a $360 administration fee. •The total cost for the 2026 Hazard Reduction Program is $43,780, which includes both contractor fees and administration fees for each property. Attachment A to Exhibit 1 provides a detailed cost breakdown by county assessor parcel number and property owner mailing address. California Government Code Sections 39560-39588 outline the enforcement and cost recovery process for weed abatement services. To recover these costs, the City Council must hold a public hearing to assess and confirm the report, providing property owners with an opportunity to voice objections. Staff recommend that the City Council adopt a resolution approving the final 2026 Hazard Reduction Cost Report. This will enable the city to recover weed abatement expenses directly from property owners by placing the abatement cost on the San Diego County tax rolls as an assessment. The San Diego County Tax Assessor will then collect those assessments. If they are uncollectable through this process, the expenses will continue to be covered by the city’s General Fund. Fiscal Analysis Most city administrative and contractor costs related to weed abatement are recoverable from property owners via their property tax bills. However, this recovery method does not apply to land valued at zero or deemed to have no taxable value. In this case, a zero-value property does not receive a property tax bill. The Fire Department’s operating budget has sufficient funds for weed abatement expenditures. The city will recoup these expenses through property tax assessments in the following fiscal year. Next Steps Exhibits 2 and 3 include the prescribed county forms required for fixed-charge special assessments. The City Clerk will file both forms, along with a certified copy of the resolution and cost report, with the San Diego County Tax Assessor by Aug. 10, 2026. Environmental Evaluation The proposed action to approve the 2026 Hazard Reduction Cost Report is categorically exempt from environmental review under California Environmental Quality Act, or CEQA, Guidelines Section 15321(a) because it involves the enforcement of a law, general rule, standard, or objective administered or adopted by the city. No exception to the exemptions as set forth in CEQA Guidelines Section 15300.2 or the Carlsbad Municipal Code Section 19.04.070 (C) applies. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE 2026 HAZARD REDUCTION COST REPORT AND DIRECTING THE CITY CLERK TO FILE A CERTIFIED COPY OF THE RESOLUTION AND REPORT WITH THE SAN DIEGO COUNTY AUDITOR BEFORE AUGUST 10, 2026 WHEREAS, on March 24, 2026, the City Council of the City of Carlsbad, California, approved Resolution No. 2026-065, declaring weeds growing upon or in front of certain property described in Attachment A in Carlsbad to be a public nuisance and authorized the City Clerk of the City of Carlsbad to notify property owners to abate the nuisance; and WHEREAS, on March 25, 2026, the City Clerk mailed written notices to property owners listed in Attachment A; and WHEREAS, property owners were notified that nuisances existing after May 15, 2026, are subject to abatement by the City of Carlsbad, and the cost of abatement would appear on the property tax bill; and WHEREAS, the mailed notices stated that the City Council would hear objections or protests, if any, to the proposed abatement on Tuesday, April 14, 2026, at 5 p.m. at the City of Carlsbad City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California; and WHEREAS, a public hearing was conducted in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, on April 14, 2026, at 5 p.m. to consider responses from property owners to said proposed removal of weeds, rubbish, and refuse; and WHEREAS, the City Council authorized the Superintendent to abate the nuisances declared by Resolution No. 2026-075 by having the weeds removed from the properties listed in Attachment A; and WHEREAS, the Fire Chief of the City of Carlsbad is designated to perform the duties imposed on the Superintendent by California Government Code Section 39560, et seq.; and WHEREAS, the Fire Chief directed the City to abate all remaining nuisances after May 15, 2026; and WHEREAS, California Government Code Section 39560, et seq. requires a cost report for abatement services to be submitted to the City Council for confirmation following a public hearing to consider any objections from property owners; and July 21, 2026 Item #6 Page 3 of 9 Docusign Envelope ID: B98B8EC9-AC5E-8F6D-8030-31BAA812C40D WHEREAS, a public hearing was scheduled in the City Council Chamber at 1200 Carlsbad Village Drive, Carlsbad, California, on July 21, 2026, at 5 p.m. to consider and confirm the final 2026 Hazard Reduction Cost Report.
