In accordance with your request, we have prepared this letter to present our opinion regarding the proposed
mitigation of pesticide residues in soils at the Poinsettia Properties site. We understand that Bridge Housing,

the pending buyer of Plaooiog .Arca 5, proposes to mitigate the presence of pesticide residues in the on-site
soils by e:ccavating the upper three to six feet of soil and burying the uppermost two feet of excavated soil at
the bottom of the e.,:cavation.
The burial option proposed is acceptable to us. Based on previous conversations with personnel from the San
Diego County Health Department, we understand that this is their preferred (though not the ooly acceptable)
mitigation alternative.

SUBJECT: San Diego County Health Department Criteria for Pesticide Residue Mitigation
Dear Ladies and Gentlemen:
In accordance with your request, we have prepared this letter to present some of the pertinent information
regarding the mitigation of pesticide residues in soils used for residential applications. We have spoken with
Mr. Kevin Heaton and Mr. David Felix, both of the County of San Diego, and have reviewed the information
in the most recent edition of the County Site Assessment and Mitigation .Manual. Based on the infoonation
from those sources the following is presented:
1) The pesticides used for the agriculnml opei:ations were presumably applied in acco~e with
standards and procedures in effect at the time of the pesticide application. The pesticide residues are
therefore not genecilly classified as hazardous waste unless they are ttansported from the site.
2) In general, the procedures used as mitigation for pesticide-impacted soils have included removal, deep
burial. dilution by mixing, or a combination of the procedures. The County of San Diego does not
prohibit dilution by mixing but they discourage it due to cbanging i:egulatoi:y standards, inaeased
ability to detect low levels of residues, ~ public peteeprion. They also discomage exporting the
pesticide-affected soils from the original site due to the possibility that the soils would then need to
be regu1ated as "hazardous waste".
3) The County of San Diego's preferred option is to buty the pesticide-affected soils on-site in an area
would the soils would not be disturbed by futun-gc,dmg or excavation. Previous locations used for
soil burial include deep canyon fills, deep utility trenches, at the base of tall .fill slopes, common
greenbelt areas, or e3:cavations made specifically to create a suitable disposal area.
4) The County of San Diego apparently does not regulate the handling of pesticide-affected soils on
gciding projects but is willing to review proposed grading plans and offer support or suggestions to

7. Containers, Preservation and Holding Time
Correct handling of samples is needed to eliminate bias and cross contamination prior to
laboratory analysis. See EPA SW-846 for correct handling procedures.
E. PESTICIDE CONTAMINATED SITES
Pesticide contaminated soil Is an area of growing environmental concern. This Is generally due
to land use changes involving proposed housing developments on former agricultural lands.
Legally applied pesticides, and the resulting in-situ residues in soil, are not regulated as hazardous
waste. However, to adequately evaluate the risk to human health and the environment posed by
the presence of residual pesticides, it Is necessary to conduct both a site assessment and a risk
assessment
1. Considerations for Pesticide Investigations
a. me
Total Threshold Limit Concentrations (TTLCs) are to be used to determine if a waste is
hazardous, for purposes of treatment or disposal. TTLCs are not health-based levels and
should not be used to set clean-up levels for remedl~on of pesticide-contaminated sites.
b. Acceptable Risk
The U.S. Environmental Protection Agency (EPA) uses one excess cancer death in
1,000,000 as the maximum acceptable risk. California's Proposition 65 uses one excess
cancer death In 100,000 as the risk level above which public notification is required.
These risk levels should be kept in mind when preparing Community Health & Safety
Plans and Risk Assessments.
c. Contaminant Depth
While the highest levels of some pesticide residues are found in the upper few feet of
soil, the complete horizontal and vertical extent of contamination must be determined.
Sampling only at deeper depths may miss the highest levels of contamination, while
sampling only at shallower depths may not be sufficient to delineate the extent of
pesticide residues. Surface. sampling may only allow assessment of exposures where
the soil Is to be left undisturbed. Proposed construction and/or excavation of subsurface
soil will require subsurface sampling to adequately assess potential exposures.
d. Background Contamination
There Is no •natural• background concentration of pesticides In soil. However, because
of widespread pesticide usage throughout the County, varying concentrations of
pesticides may be expected to be found most anywhere. Therefore, background samples
obtained off-site could also contain pesticide residues. Toe DEH suggests using CAL
EPA's guidance documents.
2. Waste Classification
Unless pesticide contaminated soil ls determined to be a waste, it cannot be considered a
hazardous waste (as defined in Section 25117 of the CalHomia Health and Safety Code)
despite existing concentrations. If the following conditions are met, the DEH would not

consider soil contaminated by the legal application of pesticides to be a waste as defined In
Section 25124 (a) of the California Health and Safety Code.
a. The soil will not be disposed of or removed from the site in any manner.
If the soil is to be transported off-site, a hazardous waste determination must be
perfonned as required in Section 66471 of the California Code of Regulations.
Contaminated soil determined to be a hazardous waste must be disposed of in
accordance with applicable State and Federal regulations. Any soil which Is
contaminated, and determined to be non-hazardous, will require the written approval of
the DEH and the Regional Water Quality Control Board prior to being transported off-site.
b. The soil will not be treated on-site.
A hazardous waste determination must be performed prior to treatment of contaminated
soil. If the soil Is determined to be hazardous, a facility permit, variance, or permit-by
rule must be obtained as required by the California Health and Safety Code and the
California Code of Regulations. Any actMty carried out for the purpose of rendering soil
less hazardous, or solely intended to dDute or mix the contaminated soil with clean soil,
would be considered treatment.

c. The soil will not pose a threat to public health or the environment.
3. Community Health and Safety
It Is the responsibility of the property owner, developer, contractor, and other responsible
parties to conduct on-site activities in a manner that will not threaten public health and safety,
or in any way degrade or threaten the environment Both immediate and long-term effects of
these actMtles must be considered. The DEH will require Immediate corrective action, as
needed, to protect public health and/or the environment.
Prior to conducting any activity on-site, the DEH strongly suggests that a Community Health
and Safety Plan be prepared. The purpose of this plan is to document measures that will be
taken to protect The surrounding community. DEH will review and comment on a Community
Health and Safety Plan upon remittance of the standard review fee.
Measures must be taken to prevent fugitive dust emissions, vapors, erosion, and any off-site
migration of pesticide contaminated soil. Grading, trenching, drilling, and all construction
activities must be conduded In a manner which protects public health and the environment.
Effective dust control Is the most Important measure which will prevent public exposure to
pesticides. Responsible parties will be accountable for monitoring off-site dust migration
during any activity conducted on-site. Any activity generating dust emissions must be
Immediately stopped If off-site migration of dust ls detected.
4. Notification
Section 25249.6 of the California Health and Safety Code (Proposition 65) requires warning
an indMdual before exposure to any chemical known to cause cancer. It Is the opinion of the
DEH that exposure to many pesticide contaminated soils would require a clear and reasonable
warning to any individual conducting any activity which exposes that lndMdual to the soil.
Warning requirements may also extend to future tenants, lessees, maintenance personnel and
the general public. In addition, Section 25359 of the California Health and Safety Code
requires an owner of non-residential real property to provide, prior to the sale, lease, or rental
of the real property, written notice of the release of a hazardous substance. It Is the opinion

Encinas and Poinsettia Avenue, Carlsbad, California
Dear Ladies and Gentlemen:
In accordance with your request, we have performed some limited sampling and testing for pesticide
residues of the near-surface soils at the subject site. This limited ~pling and testing was perfooned in
order to evaluate the amowit of pesticide residues in the soils and determine whether the residues are
below regulatory limits for residential uses. El~ven samples were obtained at representative locations at
a depth of approximately one foot to two feet t,elow the existing growid surface; the sample locations are
shown on the accompanying Plate No. 1. The sampks were submitted to an appro,;ed environmental
testing laboratory under chain-of-custody procedures for analysis.
The results of the laboratory tests indicate that detectable amounts of pesticide residues were detected in
all of the samples obtained on April 2, 1999 a a depth of approximately one foot t•J two feet. Total
Threshold Limit Concentrations (ITLC) for tl)xaphene and DDT /DDE/DDD are 5.0 mg/kg and 1.0
mg/kg, respectively. Preliminary remediation goals (PRGs) for residential soil established by the United
States Environmental Protection Agency for toxaphcne, DDT/DOE, and ODD ai:e 0.4 mg/kg, 1.7
mg/kg, and 2.4 mg/kg, respectively. A summary of the TTLCs, the PRGs, and the laboratory test results
are presented below; complete copies of the test resulcs are presented at the rear of this report.

TI1e laboratory test results indicate the followi:ig:
1) One sample (PP 3) was slightly above the TILC for ODD; none of the samples were above the
PRG forDDD.
2) Six samples were above the TIT..C for DOE; four of the samples were above the PRG for
DOE.
3) No samples were above either the n·Lc or me PRG for DDT.
4) No samples were above the ITLC for toxaphene; nine samples were above the PRG for
toxaphene.
5) The samples tested ranged from less than the recommended limit to slightly above the
recommended limit, to as much as approximuely four times the recommended limit.
Based on the laboratory test results, it is our opinion that ~fter site preparation procedl.ll.'.es associated with
the anticipated improvements, the amount of p1!sticide residues remaining in the near-surface soils-should
be sufficiently low so that "no significant risk" t) the health and safety of workers and residents is present
The "no significant risk" level assumes that that the occurrence of one excess lifetime cancer in a
population of one million is "not significant". The samples tested ranged from less than the

recommended limit to slightly above the recommended limit, to as much as approximately four times the
recommended limit. It is expected that after ble1ding the near-surface soils with other on-site soils and/ or
imported soils, the levels will be reduced to helow both the TIT..C and the PRG limits. It may be
advisable to verify this during and after gradin!; operations.
