Dear Mr. cl Mrs. Fujimoto: The Planning Director has completed a review of your application far an Administrative Variance to allow a reduced rear yald setback from 17 feet to 8.5 feet, at 3709 GJeCO\ut Way. After careful consideration of the circumstances smrounding this request, the Pbmnin1 Di1ector has determined that the four findings required far pantina an Administrative Variance can be made and, therefore, APPROVES this request based on the followina findinp and conditions. !JwHuu~ 1. The granting of this variance will not be materially detrimental to the public welfue or injurious to the property or improvements in the vicinity and zone in which the property is located. The addition will abut a 26 foot wide private access and public utility easement. This easement and the proposed 8 foot 6 inch rear yard setback assures at least a 34 foot 6 inch sepamtion between the house on the subject property and any future expansion on the adjacent poperty (Parcel 1 of Parcel Map No. 12120). In addition, a structure built to the proposed rear yard modification will not disrupt visibility for motorists exiting on the adjacent property's driveway. 4. The grantina of this variance will not adversely affect the comprehensive General Plan since the proposed JDCKtification is a standards variation limited to one single family lot This decision may be appealed by you or any member of the public to the Planning c.omm.i.s.1ion within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 2075 las Palmas Drive in Carlsbad, along with a payment of $110.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached.
