Taryan 1110 Camino Del Sol Circle Carlsbad CA 92008 SUBJECT: AV 95-02 -Administrative Variance for an eleven foot tall fence on the northerly (rear) property line of property located at 1110 Camino Del Sol Circle zoned as R-1-7500 and In Local Facllltles Management Zone 1. Dear Mr Taryan: The Planning Director has completed a review of your application for an Administrative Variance, AV 95-02 at 111 O Camino Del Sol Circle. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance cannot be made and, therefore, denies this request based on the following findings and conditions. Findings: 1. There are not exceptional o'r extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone because other properties are similar in shape, size and topography. All the lots in the vicinity are rectangular in shape, are wider than the minimum width and meet the 7500 square foot lot size requirement of the R-1-7500 zone. The property adjacent to the north is at the same elevation of the subject property. The six foot tall masonry fence along the northern property line meets five foot minimum pool fencing requirement for the subject property. The wooden fence attached to the masonry wall is above the six foot fence height allowance. 2. The requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question because no other property in the vicinity has an approved wall or fence over six feet in height. 3. The granting of this variance will be materially detrimental to the adjacent property since it would expose the property to the north of the subject property to a solid barrier eleven feet in height which reduces light and air circulation. 2075 Las Patmas Drive • Carlsbad, California 92009-1576 • (619) 438-1161 AV 95-02 -1110 CAMINO DEL SOL CIRCLE November 29, 1995 Page2 4. The granting of this variance would not adversely affect the comprehensive General Plan because the property is developed with a single-family home which is consistent with the Residential Low-Medium (ALM) General Plan Land Use designation. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 2075 Las Palmas Drive in carlsbad, along with a payment of $120.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached.
