SUBJECT: AV 97-07 -OCEAN STREET CONDOMINIUMS-PALISOUL/BLAIR
RESIDENCE.
The Planning Director has completed a review of your application for an
Administrative Variance, AV 97-07 located on the West side of Ocean Street
between Cypress Avenue and Beech Avenue. After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that
the four findings required for granting an Administrative Variance CAN be made and
therefore, APPROVES this request based on the following findings and conditions.
Findings:
1 . There ARE exceptional or extraordinary circumstances or conditions
applicable to the property or to the intended use that do not apply generally
to the other property or class of use in the same vicinity and zone because
the site has a narrow lot width which makes it impossible to provide required
parking at City standards without encroachment into the required side yard
setback.
2. The requested variance IS necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone but which is denied to the property in question because without
approval of a variance for a reduced side yard setback the applicant could not
construct the two units allowed by the General Plan because the narrow lot
width and topographical constraints make the construction of a standard
garage and parking arrangement at street level impossible.
3. The granting of this variance WOULD NOT be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which the property is located because the project side setbacks are
similar to and compatible with surrounding development and the project is
similar in intensity and scale to surrounding developments in the vicinity and
zone.

4. The granting of this variance WILL NOT adversely affect the comprehensive
General Plan because the proposed project, with the variance, remains
consistent with the General Plan. The site is designated by the General Plan
for Residential-High Density uses. • The use proposed is a residential use
which is within the allowed density range and is at or below the growth
control point.
Conditions:
1. Approval of AV 97-07 is granted subject to the approval of SDP 97-17, V
97-03, HDP 97-14, SUP 97-08, CDP 97-36, CP 97-05, and MS 97-12. AV
97-07 is subject to all conditions contained in Planning Commission
Resolution No's. 4263, 4264, 4265, 4266, and 4267 for SDP 97-17, V 97-
03, HOP 97-14, SUP 97-08, and CDP 97-36 and the Planning Department's
approval letter for CP 97-05, and the Engineering Department's approval
letter for MS 97-12.
This decision may be appealed by you or any member of the public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in
writing to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along
with a payment of $600.00 plus noticing costs. The filing of such appeal within
such time limit shall stay the effective date of the order of the Planning Director
until such time as a final decision on the appeal is reached. If you have any
