To consider and discuss the appointment of a City Manager.
If circumstances necessitate the absence of a specified designated representative, an agent
or designee may participate in place ofthe absent representative so long as the name ofthe
agent or designee is announced at an open session held prior to the closed session.
COUNCIL ACTION: Council directed City Attorney and staff on the matter.

RECOMMENDED ACTION:
I move that the City Council of the City of Carlsbad and the Board of Directors of the Carlsbad
Municipal Water District, by motion, authorize a closed session to discuss pending litigation as
follows:

Manufacturing Co., Inc. and Formosa Plastics Corporation, United
States District Court Case No. EDCV 06-55-GW pursuant to
Government Code Section 54956.9(a).
