It is the Planning Commission’s Policy to adjourn the meeting no later than 10:00 p.m. 2. Meetings are divided into categories shown below. 3. When you are called to speak, please come forward and state your name and address. 4. Persons with a disability may request an agenda packet in appropriate alternative formats as required by the Americans with Disabilities Act of 1990 by contacting the City Manager’s office at 760-434-2821 (voice), 711 (free relay service for TTY users), 760-720-9461 (fax) or manager@carlsbadca.gov by noon on the Friday preceding the meeting. PLEASE NOTE: Any agenda related writings or documents provided to the majority of the Planning Commission after distribution of the Agenda packet will be available for public inspection at the Planning Division located at 1635 Faraday Avenue, Carlsbad, CA 92008. In addition, a binder containing all agenda related writings and documents will be held by the Minutes Clerk at each Planning Commission meeting and available for public review. 6. VISUAL MATERIALS FOR PLANNING COMMISSION: Visual materials should be submitted to the Planning Division at 1635 Faraday Avenue no later than noon on the day of a Regular Planning Commission Meeting. Digital materials will be placed on a computer in Council Chambers for public presentations. Please label all materials with the agenda item number you are representing. Items submitted for viewing, including presentations/digital materials, will be included in the time limit maximum for speakers. All materials exhibited to the Planning Commission during the meeting (slides, maps, photos, etc.) are part of the public record and must be kept by the Planning Division for at least 60 days after final action on the matter. Your materials will be returned upon written request. Video clips cannot be accommodated. 7. Meeting Decorum: Carlsbad Municipal Code sections 1.20.320 and 1.20.330 require members of the public to observe order at this meeting and to conduct themselves in a courteous manner. California Penal Code section 403 makes it a misdemeanor for any person to willfully disturb or break up any assembly or meeting with lawful authority. PUBLIC COMMENT: If you desire to speak about an item not listed on the agenda, a “Time Reservation Request” form should be filed with the Minutes Clerk. A total of 15 minutes is provided for the Public Comment portion of the Agenda. Speakers are limited to three (3) minutes each. In conformance with the Brown Act, no action can occur on items presented during Public Comment. CUP 08-22(A) – VERIZON CARLSBAD HS WCF – Request for an amendment to Conditional Use Permit No. CUP 08-22 to allow for the removal and replacement of six four foot tall panel antennas with six, eight foot tall antennas, six new Remote Radio Units (RRU) and one AC power surge suppressor behind the antennas that are located on an existing light standard at the northwest corner of the athletic field within the Carlsbad High School campus located at 3557 Monroe Street and in Local Facilities Management Zone 1. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301(e) (Additions to Existing Structures) of the state CEQA guidelines. RESOLUTION NO. 7150 STAFF RECOMMENDATION: Approval PLANNER: Austin Silva ENGINEER: Tecla Levy PLANNING COMMISSION ACTION: Approved 7-0 2. CDP 14-06/CUP 15-08 – BUENA OUTFALL FORCE MAIN PHASE III – Request for the adoption of the Findings of the Final Mitigated Negative Declaration (MND), the Mitigation Monitoring and Reporting Program (MMRP) and Addendum, prepared and approved by the Buena Sanitation District, as adequate for the Buena Outfall Force Main Phase III project, and approval of a Coastal Development Permit and a Conditional Use Permit to allow the construction of a sewer pipeline and appurtenances within the Mello II Segment of the City’s Coastal Zone on property generally located within the public rights-of-way located at the northeast corner of the intersection of Palomar Airport Road and El Camino Real, traversing within the westbound lanes of Palomar Airport Road, and continuing south on Paseo del Norte for approximately 1,200 feet within Local Facilities Management Zones 3, 5 and 13. The project is appealable to the California Coastal Commission per Section 30603(a)(5) of the Public Resources Code of the California Coastal Act, which states any development which constitutes a major public works project costing $100,000 or more is appealable to the Commission. CT 15-06/RP 15-07 – THE WAVE – Request for a recommendation of approval of a Tentative Tract Map and Major Review Permit to allow for the demolition of all structures onsite and the construction of a four-story mixed-use building consisting of 8 residential units, 13 timeshare units, 781 square feet of commercial space and a two level enclosed parking garage situated on a 0.249-acre project site located at 2646 State Street within District 4 – Residential Support Area of the Village Review (VR) Zone and Local Facilities Management Zone 1. The project qualifies as a CEQA Guidelines Section 15332 (In-Fill Development Projects) Class 32 Categorical Exemption. SP 180(I) – CARLSBAD RESEARCH CENTER SPECIFIC PLAN AMENDMENT FOR LOT 75 – Request for a recommendation of approval of a Specific Plan Amendment to include a new land use category (Area 2c – Light Industrial/Commercial Tourist) that would allow a commercial hotel and related business traveler uses on Lot 75 of the Carlsbad Research Center Specific Plan with the approval of a Conditional Use Permit. The property is generally located on the southwest corner of Faraday Avenue and Van Allen Way within the Carlsbad Research Center and in Local Facilities Management Zone 5. The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(B)(3) (General Rule) and City of Carlsbad Municipal Code Chapter 19.04.070(A)(1)(c), minor municipal code amendments that do not involve physical modifications or lead to physical improvements beyond those typically exempt. SDP 15-20 – QUARRY CREEK PLANNING AREA P-3 – Request for a determination that the project is within the scope of the previously certified Quarry Creek Master Plan Environmental Impact Report (EIR 11-02) and approval of a Site Development Plan for the development of a common recreation facility to serve Quarry Creek Planning Areas R-3 and R-4 that includes a 2,281 square foot recreation building, swimming pool, passive park area, and parking on 1.3 acres located north of Marron Road, south of Adobe Springs Road, and west of El Salto Falls Street in Local Facilities Management Zone 25. SDP 15-17 – QUARRY CREEK PA R-1 – Request for a determination that the project is within the scope of the previously certified Quarry Creek Master Plan Environmental Impact Report (EIR 11-02) and approval of a Site Development Plan for the development of 5 multi-family buildings for 64 affordable rental residential units within Planning Area R-1 within the Quarry Creek Master Plan on property located south of Haymar Drive and west of future private Street A in the Quarry Creek Master Plan in Local Facilities Management Zone 25. RESOLUTION NO. 7151 STAFF RECOMMENDATION: Approval PLANNER: Christer Westman ENGINEER: Tecla Levy PLANNING COMMISSION ACTION: Approved as Amended 7-0 Planning Commission Member Comments City Planner Comments City Attorney Comments TIME: 10:50 p.m. PLANNING COMMISSION AGENDA March 16, 2016 Page 5 PLANNING COMMISSION PROCEDURE For those in the audience who are not familiar with the operation of a Planning Commission, the following is a summary of the procedure: For each item on the agenda, the planning staff will present a report to the Planning Commission. On items for public hearing, the audience will be asked for comment. Those wishing to speak are asked to come forward, speak into the microphone, and give their name and address for the taped record. A time limit of five minutes is allotted to each speaker. After testimony is completed, the applicant is allowed a rebuttal. The Planning Commission is anxious to hear all persons wishing to give testimony. However, it is requested that each new speaker add new information, and not repeat points which previous speakers have made. Persons not desiring to speak, but wishing to be recorded as proponents or protesters of record, may do so by submitting their name and address to the minutes clerk. Certain Planning Commission decisions are final, but may be appealed to the City Council. An appeal may be filed with the City Clerk at City Hall within 10 calendar days of the decision. The cost of filing an appeal is $1,097 plus noticing fees for all matters. If anyone wishes to question a Planning Commission decision, they may contact the Planning Division at 1635 Faraday Avenue, between the hours of 7:30 and 5:30, Monday through Thursday, and 8:00 to 5:00 on Friday. The proposed plan amendment to create a new hybrid Land Use category (Area 2c) that would allow either Light Industrial uses as currently permitted in (Area 1) or a commercial hotel and related business traveler uses on Lot 75 of the CRC Specific Plan would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that the Carlsbad Research Center SP 180(H) provides development standards and regulations that are intended to promote well designed and compatible development within the area identified as the Carlsbad Research Center Specific Plan. The future physical development of the project site (Lot 75) requires compliance with these development standards. To accommodate the future residents recreational needs, the recreation building phase 1 shall be completed prior to or concurrent with issuance of occupancy for the 55th dwelling unit within Planning Area R-3 or R-3/R-4 combined; The swimming pool phase II shall be completed prior to or concurrent with the issuance of occupancy for the 100th dwelling unit within Planning Areas R-3/R-4 combined; and all phases shall be complete prior to or concurrent with issuance of occupancy of the 155th dwelling unit within Planning areas R-3/R-4 combined. 90'Scale 1" = 30'30'15'0North
