T 8JO.~SU.18!8 f !i,0632.0IH MEMORANDUM Jim Grant, Grant Construction Adam Poll, Air Quality Specialist/Planner; Dudek Coastline Church Master Plan Buildout Climate Action Plan Compliance June 12, 2018 Sean Kilkenny; Dudek A -Greenhouse Gas Emission Calculations B -Climate Action Plan Consistency Checklist This memorandum serves to outline the Coastline Church Master Plan Buildout (project's) compliance with the City of Carlsbad (City) Climate Action Plan (CAP). 1 PROJECT DESCRIPTION The project would replace an existing 10,000 square feet of administrative and ministerial space with a 23,746 square foot children's ministry building. The proposed 2-story ministry center is comprised of classrooms and break-out rooms for pre-school to Jr. High age children. The multi- purpose room on the ground floor is designed for kids worship. This floor is also the home for the administrative offices which oversee management and day to day operation of the church. The ministry center is not designed to function as a school or day-care facility during the week. The project would also include the addition of 70 parking spaces to the existing church parking lot. The project also includes construction of a new 2-story maintenance building that will provide shelter for golf-type carts that are used on the campus that is approximately 1,374 square feet. It will also be used for storage oflawn mower and gardening equipment. The existing worship center is planned to be expanded as part of the project to increase capacity from 280 to 430, which includes an increase in square feet of 2,141. This part of the project includes interior remodeling to reconfigure the seating. The existing cafe is also planned to be expanded under the project to include converting the existing toiler rooms to multi-stall toilet rooms, which will require an additional 442 square feet. The project is zoned Planned Community (P-C) within the Arroyo La Costa Master Plan in Village "J". It is zoned for church/education/community cen er ~~ residential. 2 CITY OF CARLSBAD CAP CONSIST ANCY In September 2015, the City's Final CAP was adopted, followed by a three-step "CAP Consistency Checklist Questions," which was last updated in February 2017. Consistency with Step l consists of an evaluation to determine the project's consistency with the existing General Plan, Community Plan, and zoning designations for the site. The Step 2 evaluation includes a measure-by-measure explanation as to how the project will implement the required measures delineated in the Checklist under Step 2. 2.1 Step 1 -Land Use Consistency Consistency with Step l consists of an evaluation to determine the project's consistency with existing General Plan, Community Plan, and zoning designations for the site. Step l ( question 1) asks whether the project falls within a certain size. As the Project is a church community center and fits within the "Other" category, in order for it to be consistent with this step it will need to prove that the project's greenhouse gas (GHG) emissions are less than the 900 metric tons of carbon dioxide equivalent (MT CO2e) screening threshold. Dudek estimated the GHG emissions from the project utilizing the following assumptions for both construction and operation. CONSTRUCTION Emissions from the construction phase of the Project were estimated using the California Emissions Estimator Model (CalEEMod) Version 20 l 6.3.2 (CAPCOA 2017). For the purposes of modeling, it was assumed that construction of the Project would commence in Februar 2019 and would last a roximately 11 months, ending in December 2019. The analysis contained herein is based on the assumptions outlined in Table 1 (duration of phases is approximate). The Project schedule was based on information provided by the Project applicant. For the analysis, it was generally assumed that heavy construction equipment would be operating at the site for 5 days per week (22 days per month) during Project construction. The CalEEMod default assumptions were used for equipment size. Average daily worker trips were based on CalEEMod defaults. Hauling and vendor trips were also included for the Project to account for soil import, soil export, and material delivery. A detailed depiction of the construction schedule-including information regarding sub phases and equipment used during each subphase-is included in Attachment A of this report. The information contained in Attachment A was used as CalEEMod model inputs. Table 3 shows the estimated annual GHG construction emissions associated with the Project, as well as the amortized construction emissions over a 30-year "project life." OPERATION Emissions from the operational phase of the Project were estimated using CalEEMod. Operational year 2020 was assumed as it would be the first full year following completion of construction. Area Sources CalEEMod was used to estimate operational emissions from area sources, including emissions from landscape maintenance equipment. Emissions associated with natural gas usage in space heating and water heating are calculated in the building energy use module of CalEEMod, as described in the following text. Landscape maintenance includes fuel combustion emissions from equipment such as lawn mowers, rototillers, shredders/grinders, blowers, trimmers, chainsaws, and hedge trimmers. The emissions associated with landscape equipment use are estimated based on CalEEMod default values for emission factors (grams per square foot of building space per day) and number of summer days (when landscape maintenance would generally be performed) and winter days. For San Diego County, the average annual number of summer days is estimated at 180 days (CAPCOA 2017). Energy Sources As represented in CalEEMod, energy sources include GHG emissions associated with building electricity and natural gas usage (non-hearth). Title 24 of the California Code of Regulations serves to enhance and regulate California's building standards. The most recent amendments to Title 24, Part 6, referred to as the 2016 standards, became effective on January 1, 2017. The previous amendments were referred to as the 2013 standards. CalEEMod 2016.3.2 includes compliance with the 2016 Title 24 standards. The Project applicant is committed to exceeding the 2016 Title 24 energy standards; however, as a conservative measure compliance with the 2016 Title 24 standard was assumed. The project applicant provided estimated electricity and natural gas usage for the Project based off of historical use of the site. Mobile Sources Foll owing the completion of construction activities, the Project would generate GHG emissions from mobile sources (vehicular traffic) as a result of the customers of the Project. The estimated trip lengths and trip modes were based on CalEEMod defaults. The CalEEMod model was used to estimate emissions from proposed vehicular sources (refer to Attachment A). CalEEMod default data, including temperature, trip characteristics, variable start information, emissions factors, and trip distances, were conservatively used for the model inputs. Project-related traffic was assumed to include a mixture of vehicles in accordance with the associated use, as modeled within the CalEEMod. Emission factors representing the vehicle mix and emissions for 2020 were conservatively used to estimate emissions associated with vehicular sources. Solid Waste The Project would generate solid waste and would, therefore, result in CO2e emissions associated with landfill off-gassing. Solid waste generation was derived from the CalEEMod default rates for each land use type. Emission estimates associated with solid waste were estimated using CalEEMod. Water Supply and Wastewater Water supplied to the Project requires the use of electricity. Accordingly, the supply, conveyance, treatment, and distribution of water would indirectly result in GHG emissions through use of electricity. Annual water use for the Project and GHG emissions associated with the electricity used for water supply were calculated based upon default water use estimates for each land-use type, as estimated by CalEEMod and San Diego Gas and Electric factors. The estimated operational (year 2020) Project-generated GHG emissions from area sources, energy usage, motor vehicles, solid waste generation, and water usage and wastewater generation are shown in Table 4. As shown in Table 4, estimated annual Project-generated GHG emissions in 2020 would be approximately 339 MT C02e per year as a result of Project operations. As previously discussed, if a project does not exceed the 900 MT C02e per year screening threshold it would not contribute considerably to cumulative climate change impacts as stated in the City's CAP, and therefore, do not need to demonstrate consistency with the CAP. In accordance with the City's CAP screening criteria, the project's GHG impact would be less than significant and is not subj ect to the measures of the CAP. The purpose of the CAP Consistency Checklist (Checklist) is to, in conjunction with the CAP, provide a streamlined review process for proposed new development projects that are subject to discretionary review and trigger environmental review pursuant to the California Environmental Quality Act (CEQA). Analysis of GHG emissions and potential climate change impacts from new development is required under CEQA. The CAP is a plan for the reduction of GHG emissions in accordance with CEQA Guidelines Section 15183.5. Pursuant to CEQA Guidelines Sections 15064(h)(3), 15130(d), and 15183(b), a project's incremental contribution to a cumulative GHG emissions effect may be determined not to be cumulatively considerable if it complies with the requirements of the CAP. This Checklist contains measures that are required to be implemented on a project-by-project basis to ensure that the specified emissions targets identified in the CAP are achieved. Implementation of these measures would ensure that new development is consistent with the CAP's assumption for relevant CAP strategies toward achieving the identified GHG reduction targets. Projects that are consistent with the CAP as determined through the use of this Checklist may rely on the CAP for the cumulative impacts analysis of GHG emissions. Projects that are not consistent with the CAP must prepare a comprehensive project-specific analysis of GHG emissions, including quantification of existing and projected GHG emissions and incorporation of the measures in this Checklist to the extent feasible. Governmental police power, and the existence or violation of those portions of any law or government regulation concerning: (a) building; (d) improvements on the Land; (b) zoning; (c) land use; (e) land division; and (f) environmental protection. This Exclusion does not limit the coverage described in Covered Risk 8.a., 14, 15, 16, 18, 19, 20, 23 or 27. 2. The failure of Your existing structures, or any part of them, to be constructed in accordance with applicable building codes. This Exclusion does not limit the coverage described in Covered Risk 14 or 15. 3. The right to take the Land by condemning it. This Exclusion does not limit the coverage described in Covered Risk 17. 4. Risks: (a) that are created, allowed, or agreed to by You, whether or not they are recorded in the Public Records; (b) that are Known to You at the Policy Date, but not to Us, unless they are recorded in the Public Records at the Policy Date; (c) that result in no loss to You; or (d) that first occur after the Policy Date -this does not limit the coverage described in Covered Risk 7, 8.e., 25, 26, 27 or 28. 5. Failure to pay value for Your Title. 6. Lack of a right: (a) to any land outside the area specifically described and referred to in paragraph 3 of Schedule A; and (b) in streets, alleys, or waterways that touch the Land. This Exclusion does not limit the coverage described in Covered Risk 11 or 21. 7. The transfer of the Title to You is invalid as a preferential transfer or as a fraudulent transfer or conveyance under federal bankruptcy, state insolvency, or similar creditors' rights laws. LIMITATIONS ON COVERED RISKS Your insurance for the following Covered Risks is limited on the Owner's Coverage Statement as follows: For Covered Risk 16, 18, 19, and 21 Your Deductible Amount and Our Maximum Dollar Limit of Liability shown in Schedule A. Your Deductible Amount Covered Risk 16: 1% of Policy Amount or $2,500.00 (whichever is less) Covered Risk 18: 1% of Policy Amount or $5,000.00 (whichever is less) Covered Risk 19: 1% of Policy Amount or $5,000.00 (whichever is less) Covered Risk 21: 1% of Policy Amount or $2,500.00 (whichever is less) Our Maximum Dollar Limit of Ljability $10,000.00 $25,000.00 $25,000.00 $5,000.00 ALTA RESIDENTIAL TITLE INSURANCE POLICY (6-1-87) EXCLUSIONS In addition to the Exceptions in Schedule B, you are not insured against loss, costs, attorneys' fees, and expenses resulting from: 1. Governmental police power, and the existence or violation of any law or government regulation. This includes building and zoning ordinances and also laws and regulations concerning: (a) and use (b) improvements on the land (c) and division (d) environmental protection This exclusion does not apply to violations or the enforcement of these matters which appear in the public records at Policy Date. This exclusion does not limit the zoning coverage described in Items 12 and 13 of Covered Title Risks. 2. Failure to pay value for your title. 5. Lack of a right: (a) to any land outside the area specifically described and referred to in Item 3 of Schedule A OR (b) in streets, alleys, or waterways that touch your land This exclusion does not limit the access coverage in Item 5 of Covered Title Risks. 2006 ALTA LOAN POLICY (06-17-06) EXCLUSIONS FROM COVERAGE Toe following matters are expressly excluded from the coverage of this policy, and the Company will not pay loss or damage, costs, attorneys' fees, or expenses that arise by reason of: 1. a. Any law, ordinance, permit, or governmental regulation (including those relating to building and zoning) restricting, regulating, prohibiting, or relating to i. the occupancy, use, or enjoyment of the Land; ii. the character, dimensions, or location of any improvement erected on the Land; iii. the subdivision of land; or iv. environmental protection; or the effect of any violation of these laws, ordinances, or governmental regulations. This Exclusion l(a) does not modify or limit the coverage provided under Covered Risk 5. b. Any governmental police power. This Exclusion l(b) does not modify or limit the coverage provided under Covered Risk 6. 2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8. 3. Defects, liens, encumbrances, adverse claims, or other matters a. created, suffered, assumed, or agreed to by the Insured Claimant; b. not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this policy; c. resulting in no loss or damage to the Insured Claimant; d. attaching or created subsequent to Date of Policy (however, this does not modify or limit the coverage provided under Covered Risk 11, 13, or 14); or e. resulting in loss or damage that would not have been sustained if the Insured Claimant had paid value for the Insured Mortgage. 4. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of an Insured to comply with applicable doing-business laws of the state where the Land is situated. 5. Invalidity or unenforceability in whole or in part of the lien of the Insured Mortgage that arises out of the transaction evidenced by the Insured Mortgage and is based upon usury or any consumer credit protection or truth-in-lending law. 6. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction creating the lien of the Insured Mortgage, is a. a fraudulent conveyance or fraudulent transfer, or b. a preferential transfer for any reason not stated in Covered Risk 13(b) of this policy. 7. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching between Date of Policy and the date of recording of the Insured Mortgage in the Public Records. This Exclusion does not modify or limit the coverage provided under Covered Risk ll(b). Toe above policy form may be issued to afford either Standard Coverage or Extended Coverage. Any facts, rights, interests, or claims that are not shown by the Public Records but that could be ascertained by an inspection of the Land or that may be asserted by persons in possession of the Land. 3. Easements, liens or encumbrances, or claims thereof, not shown by the Public Records. 4. Any encroachment, encumbrance, violation, variation, or adverse circumstance affecting the Title that would be disclosed by an accurate and complete land survey of the Land and not shown by the Public Records. 5. (a) Unpatented mining claims; (b) reservations or exceptions in patents or in Acts authorizing the issuance thereof; (c) water rights, claims or title to water, whether or not the matters excepted under (a), (b), or (c) are shown by the Public Records. 6. Any lien or right to a lien for services, labor or material not shown by the public records. 2006 ALTA OWNER'S POUCY (06-17-06) EXCLUSIONS FROM COVERAGE The following matters are expressly excluded from the coverage of this policy, and the Company will not pay loss or damage, costs, attorneys' fees, or expenses that arise by reason of: 1. a. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction vesting the Title as shown in Schedule A, is a. a fraudulent conveyance or fraudulent transfer; or b. a preferential transfer for any reason not stated in Covered Risk 9 of this policy. 5. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching between Date of Policy and the date of recording of the deed or other instrument of transfer in the Public Records that vests Title as shown in Schedule A. The above policy form may be issued to afford either Standard Coverage or Extended Coverage. In addition to the above Exclusions from Coverage, the Exceptions from Coverage in a Standard Coverage policy will also include the following Exceptions from Coverage: EXCEPTIONS FROM COVERAGE This policy does not insure against loss or damage (and the Company will not pay costs, attorneys' fees or expenses) that arise by reason of: 1. Any law, ordinance, permit, or governmental regulation (including those relating to building and zoning) restricting, regulating, prohibiting, or relating to i. the occupancy, use, or enjoyment of the Land; ii. the character, dimensions, or location of any improvement erected on the Land; iii. the subdivision of land; or iv. environmental protection; or the effect of any violation of these laws, ordinances, or governmental regulations. This Exclusion l(a) does not modify or limit the coverage provided under Covered Risk 5, 6, 13(c), 13(d), 14 or 16. b. Any governmental police power. This Exclusion l(b) does not modify or limit the coverage provided under Covered Risk 5, 6, 13( c), 13( d), 14 or 16. 2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8. 3. Defects, liens, encumbrances, adverse claims, or other matters a. created, suffered, assumed, or agreed to by the Insured Claimant; b. not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this policy; c. resulting in no loss or damage to the Insured Claimant; d. attaching or created subsequent to Date of Policy (however, this does not modify or limit the coverage provided under Covered Risk 11, 16, 17, 18, 19, 20, 21, 22, 23, 24, 27 or 28); or e. resulting in loss or damage that would not have been sustained if the Insured Claimant had paid value for the Insured Mortgage. 4. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of an Insured to comply with applicable doing-business laws of the state where the Land is situated. 5. Invalidity or unenforceability in whole or in part of the lien of the Insured Mortgage that arises out of the transaction evidenced by the Insured Mortgage and is based upon usury or any consumer credit protection or truth-in-lending law. This Exclusion does not modify or limit the coverage provided in Covered Risk 26. 6. Any claim of invalidity, unenforceability or lack of priority of the lien of the Insured Mortgage as to Advances or modifications made after the Insured has Knowledge that the vestee shown in Schedule A is no longer the owner of the estate or interest covered by this policy. This Exclusion does not modify or limit the coverage provided in Covered Risk 11. 7. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching subsequent to Date of Policy. This Exclusion does not modify or limit the coverage provided in Covered Risk ll(b) or 25. 8. The failure of the residential structure, or any portion of it, to have been constructed before, on or after Date of Policy in accordance with applicable building codes. This Exclusion does not modify or limit the coverage provided in Covered Risk 5 or 6. 9. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction creating the lien of the Insured Mortgage, is a. a fraudulent conveyance or fraudulent transfer, or b. a preferential transfer for any reason not stated in Covered Risk 27(b) of this policy.
