Dear Mr. Emard:
The following is in regard to your above referenced request, which is currently under
review. As required by section 21.44.060 (c) and 21.51.040 of the Carlsbad Municipal
Code, public noticing is required in order to approve your request. Please find attached
copies of these code sections and the noticing package requirements, which should be
submitted to our office as soon as possible. ·
Please include with your submittal payment for postage at 33 cents per label. As stated
in the attached requirements, please provide adhesive mailing labels with the type-
written address in the exact format requested. Do NOT send envelopes.
The Planning Director will render his decision no sooner than 15 days from the date of
the mailing.
If you no longer park your boat in your front yard setback and do not wish to pursue this
variance, please provide a written statement to our office, so that we may remove your
violation from Code Enforcement's records.

SUBJECT: Request for Permission to Park a Recreational Vehicle in the
Front Yard Setback at 4930 Hillside Drive
The Planning Director has completed a review of your request to park a 10'-5" wide, 20'
long boat in your front yard setback, pursuant to section 21.44.060 of the Carlsbad
Municipal Code. After careful consideration of the circumstances surrounding this
request, the Planning Director has determined that the findings required for allowing the
parking of a recreational vehicle in the front yard setback can be made and therefore
APPROVES this request based on the following findings.
Findings:
1. That parking in or access to the side yard would require structural alteration to the
existing residence or would require the removal of significant or unique landscaping
in that both side yards are 7' wide, which does not allow for a 10'-5' wide boat.
2. That parking in or access to the side or rear yard would require extensive grading in
that the property slopes upward at the sides and rear of the property.
3. That allowing the recreational vehicle in the front yard will not interfere with traffic on
the street or sidewalk or encroach into the street and utility right of way or interfere
with visibility to or from any street in that there is adequate site distance and the lot
in question is an interior lot.
