JUSTIFICATION FOR RV ADMINISTRATIVE VARIANCE
An RV Administrative Variance may be approved if the Planning Director determines that
access to the side or rear yard cannot be provided. In order to approve the request, the
Planning Director shall be required to make the following findings. Please read these
carefully and explain how the proposed project meets each of them. Use additional
sheets if necessary.
1. Parking in or access to the side or rear yard would require one of more of the
following: a) extensive grading, b) structural alteration to the existing residence, or c) the
removal of significant or unique landscaping. A fence shall not be deemed to prevent
access to the side or rear yard.

JUSTIFICATION FOR RV ADMINISTRATIVE VARIANCE
(RV Variance - McNulty 1737 Mallow Ct.)
1. As described below and shown in attached photographic exhibits, "A" - "E" at the
residence of 1737 Mallow Court, parking and/or access into the side or rear yard will require:
a) extensive grading, b) structural alterations and c) removal of significant and unique
landscaping.
West Side-yard
Attached as exhibits "A" —"C" are photographs of the west side yard. The west side-yard
is approximately 10' feet wide from the structure to neighboring property line and fence. There
are a number of significant obstructions precluding access and parking of the boat and trailer that
needs at least space eight foot wide and twenty feet long.
First, the west side yard slopes toward the house and consists of a large planter. (See
photo exhibits "A" and "B".) Extensive grading will be required to level the slope and planter.
This grading would be very difficult, expensive and potentially destabilizing to the neighboring
property. Shoring will be needed after the slope is dug out. Within the slope area there are
various irrigation pipes, sprinkler system and drainage pipes. Also within the planter-slope area
is a large pine tree stump with and extensive root system that will have to be removed. (See
photo Exhibit "C") Grading of the slope area will require the removal of significant landscaping
well out into the front driveway area and involve destruction of well-established plant life. (See
photo exhibit "A" —"C")
Second, the wide side yard has a large tree shown in photo exhibit " A". This tree is
approximately 10 feet from the gate. This tree will have to be removed to allow west side yard
parking or access.
Third, structural alterations will have to be made to the house to allow side yard parking.
Approximately, 14 feet from the side yard gate in a bay window that extends out approximately
2 feet into the west side yard. (See photo exhibit "A".) This window will have to be removed to
allow side yard parking. There is water pipe system shown in photo exhibit "A". This piping
will have to be removed to allow west side yard access.
Overall, it is not realistically possible to create parking for the boat in the west side yard
without extensive grading, structural alterations and removal of a lot of landscaping.
Side-yard on East-Side
Attached as exhibit "E" are photographs of the east side-yard. The width of the east side-
yard is only 6 feet wide from the house structure and neighbor's property line and fence. The
space is not wide enough to fit the boat without significant structural alterations to the house.
Additionally, the gas and electric meters are located in the east side yard.
2. Parking of the boat in the front driveway location shown in photo exhibit "D" and on the
submitted site plan drawing does not interfere with visibility to or from the street. The boat
location is in the rear west side of the driveway, over 20 feet from the sidewalk and street,
Mallow Court. (See site plan drawing.) The boat is not very large, 20 by 7 Meet.
Additionally, vegetation on the east and west side and east side of the property conceals a good
portion of the boat from west and east view angles on the street. (See exhibits "D" and "E".)
3. Parking of the boat in the location shown in photo exhibit "D" does not interfere with
traffic on the street or sidewalk. The boat location is in the rear west side of the driveway, over
20 feet from the sidewalk and Street, Mallow Court. (See site plan drawing and exhibits "D" -
"F".) Vegetation on the east and west side and east side of the property conceals a good portion
of the boat from many viewing angles from the street. With the boat on the front driveway, we
still have easy access to our garage, where both our vehicles are parked.
Finally, the boat location on the rear of the driveway does not interfere with any utility
right of way. The gas and electric utilities are located in the east side yard. The water utility is
located in the front grass lawn.

Description/Explanation:
Pursuant to Carlsbad Municipal Code section 21.44.60(2)(C), an administrative variance is
requested to permit the parking of a boat with trailer in the rear area of the front driveway. As described
in the "Justification for RV Administrative Variance" form, shown in photographic exhibits "A - E" and
the submitted site plan, parking and/or access to the side or rear yard will require a) extensive
grading, b) structural alterations and c) removal of significant and unique landscaping.
Parking of the boat in the rear area of the driveway as shown in exhibits "D" and "E" and
the submitted site plan does not cause and visual obstructions to the street, interfere with traffic
or sidewalk use. The boat location is in the rear west side of the driveway, over 20 feet from the
sidewalk and street, Mallow Court. (See site plan drawing.) The boat is not very large, 20 by 7
Vz feet. Additionally, vegetation on the east and west side of the property conceals a good
portion of the boat from west and east view angles from the street. (See exhibits "D" and "E".)
I have been informed and noticed that various other persons residing in this neighborhood
and similarly zoned Carlsbad neighborhoods have been allowed front yard parking of various
types of recreational vehicles, including boats, when there is a lack of side yard access on the
property. I have had the boat in the front driveway for almost one year, and none of my
neighbors have made any complaints to me about the boat.
Finally, I have conducted research on the availability of off-site storage of the boat.
Presently, there are no storage facilities with space available for this boat in Carlsbad, Encinitas
or Oceanside. Storage may be available in Escondido, but at costs of over $100 per month.
