The City Planner has completed a review of your application for an Administrative Variance, AV 15-06 in
the Arterro Development (Lots 12, 14, 24, 33, 37, 39, 42, 48, and 55 of Map 15918 Carlsbad Tract No. 08-
03) to allow up to 50% lot coverage in order to be able to construct patio covers and/or decks on the
specified lots. After careful consideration of the circumstances surrounding this request, the City Planner
has determined that the four findings required for granting an Administrative Variance can be made and
therefore, APPROVES this request based on the following findings and conditions.
Findings:
1. That because of special circumstances applicable to the subject property, including size, shape,
topography, location or surroundings, the strict application of the zoning ordinance deprives such
property of privileges enjoyed by other property in the vicinity and under identical zoning
classification in that the lots with one-story single-family residences have a larger lot coverage than
the lots in the same development with two-story single-family residences. The larger lot coverage
on the lots with single-family residences restricts the property owner's ability to construct patio
covers and decks as those lots are near the maximum lot coverage of 40%.
2. That the variance shall not constitute a grant of special privileges inconsistent with the limitations
upon other properties in the vicinity and zone in which the subject property is located and is subject
to any conditions necessary to assure compliance with this finding in that granting the variance will
allow patio covers to be constructed on lots with one-story single-family residences. Lots with two-
story single-family residences have the lot coverage capacity to construct patio covers and decks,
so all property owners will be able to enjoy the privilege of having patio covers and/or decks on
their lots. No special privileges will be granted to the property owners of the lots with single-family
residences. This same provision has also been granted to the surrounding villages of La Costa
Master Plan Development.
3. That the variance does not authorize a use or activity which is not otherwise expressly authorized by
the zone regulation governing the subject property in that patio covers and decks are an allowed use
in the R-1 (single-family residential zone) if the lot coverage, setback, and height requirements are
adhered to.
