JUSTIFICATION FOR VARIANCE

By law a Variance may be approved only if certain facts are found to exist.
Please read these requirements carefully and explain how the proposed project
meets each of these facts. Use additional sheets if necessary.
1) Explain why there are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended use that do not apply
generally to the other property or class of use in the same vicinity and zone:
Because of the extreme slope of the site, placing the tennis
court corner within the building setback mitigates grading by:
reducing the amount of cut required, lowering the height and
decreasing the amount of retaining walls, and measures for erosion
control are minimized.
2) . Explain why such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the same vicinity
and zone but which is denied to the property in question:
‘The placement of a tennis court on the property other than as
indicated on the plans would not be feasible due to extreme
grading conditions which would result.
3) Explain why the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located:
Due to the low density of the surrounding area the placement
of the tennis court within the setback would not be detrimental
in any way. The nearest structure to the tennis court is
approximately 100 ft. down slope at a much lower elevation. There
are no other structures within 400 ft. of the court and these are
well above the tennis courts finish grade.
4) Explain why the granting of such variance will not adversely affect the
comprehensive plan :
All construction is within zoning and code requirements. By
granting the variance the court would not adversely affect the
surroundings, physically 01 visually.
