SUBJECT: ADMINISTRATIVE VARIANCE NO. AV 87-3 - Request to
encroach two feet into required seven foot six inch
side yard with proposed family room and bathroom
addition.
Dear Mr. Hall:
The Planning Director has completed a review of your
application for an administrative variance at 3210 Canyon
Street. After careful consideration of the circumstances
surrounding this request, the Planning Director has
determined that the four findings required for granting an
administrative variance cannot be made and, therefore, denies this request based on the following findings:
Findinus :
1. There are no exceptional or extraordinary circumstances or conditions applicable to the property or to the
intended use that do not generally apply to the other property or class of use in the same vicinity and zone.
The lot is rectangular, 75 feet by 109 feet. There is
an existing house presently meeting all development
standards on the lot. There is ample room for expansion
on the lot without a variance.
2. The requested variance is not necessary for the
preservation and enjoyment of a substantial property
right possessed by other property in the same vicinity
and zone but which is denied to the property in
question. The substantial property right enjoyed in an
R-1 zone is a single family home. The applicant is
requesting a special privilege. There is no necessity
for the variance. The proposed addition can be
redesigned to meet the setback requirements.

3. The granting of this variance could be indirectly detrimental to the public welfare by creating visual impacts in reducing side yards below what the ordinance
intended.
You have the right to appeal this decision to the Planning Commission within 10 days of the receipt of this letter. If you have any questions regarding this matter, please feel free to call this office.
