Dear Mr. Holzniller,
We would like to be on record as strongly opposing the
application for administrative variance filed by Steven
Weies. We know that the minimum height required for a fence
surrounding a pool or spa is 5’. From Mr. Weiss’s side of
the fence the requirement appears to be met without violating
the maximum limit set by code. However, when the fence is
measured from the original grade, that is from the ground not
from the top of the decking, the fence is over code for
approximately a 27’ span.
Mr. Weiss told us that the reason he built his fence so high
was because of his raised spa and his desire for privacy. As
you know, the purpose of an enclosure surrounding a pool or
spa is to keep people from entering the area unsupervised and
unwanted. Mr. Weiss’s reason for having the fence so high
has nothing to do with the safety of the public. It is only
to satisfy his need for extreme privacy. Because Mr. Weiss’s
request does not meet all four parts of the criteria set
forth by the City we request that his application be denied.
Because a physical inspection of the property is required and
we would like you or your associate to be able to see the
fence from both sides, we would be very happy to have you
come to our house and inspect the fence from our side. Please
