RE: Effort for acquisition of 5 ft. strip of land adjacent
to a proposed lot split, Case No. AV 88-9, APN 167-070-30.
Dear Sirs,
An effort has been made by Mr. R.S. Smith, owner of Parcel 3
of M.S. 692, to acquire a 5 ft. strip of property adjacent
to the northern boundary of Parcel 3. Acquisition of said
property was attempted in order to avoid the Administrative
Variance process. The owner of the adjacent property has refused sale of a 5 ft. strip of property due to the
hardship it would cause to his agricultural business. The hardship involved would be relocation of a farm access road farther north, rebuilding the southern ends of 4 greenhouses,
and a decrease in the amount of acreage used in farming.
The Administrative Variance has been submitted to the City
of Carlsbad to allow lot widths of 72.5 ft.(2.5 ft. below
required standards). This was done after every effort had been made to acquire adjacent property.
