SUBJECT: ADMINISTRATIVE VARIANCE NO. 89-4 - Request for a 6 foot walllfence in front
yard setback.
Dear Mr. Buchanan:
The Planning Director has completed a review of your application for an Administrative Variance
at 2564 Navarra Drive. Mer careful consideration of the circumstances surrounding this request,
the Planning Director has determined that the four findings required for granting an
Administrative Variance AV 89-4 be made and, therefore, APPROVES this request based on the
following findings and conditions.
Findinas:
1. There are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or class
of use in the same vicinity and zone. The subject condominium was built in 1973 and
designed so that uncovered resident parking is located in the front of the lot.
Surrounding condominium projects are newer and have been designed so that walls
screen the interior, including parking areas, from view along the street. This design
provides the surrounding properties with more privacy than the subject condominium.
2. The requested variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone but which is
denied to the property in question because the projects existing required parking areas
are located directly behind the 20’ front yard setback. This design precludes the
placement of a wall outside the required 20’ front yard setback to screen uncovered
residential parking spaces. The parking area cannot be redesigned to provide a greater
front yard setback. The surrounding condominiums are enclosed by walls or have
garages along private driveways with front yard setbacks less than 20’. This design is
also aesthetically superior.
3. The granting of this variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which the property
is located because the wall does not create any sight distance problems and is
compatible with surrounding properties.

4. The granting of this variance will not adversely affect the comprehensive General Plan
because the wall is accessory to an existing condominium complex.
Conditions:
7) The wall shall be constructed in accordance with Exhibit “A, incorporated herein by
reference and on file in the Planning Department. A 10’ setback from the property line
shall be provided at all points along Navarra Drive.
2) No security gate shall be installed due to the lack of an adequate turnaround area for
visitors.
You have the right to appeal this decision to the Planning Commission within ten days of receipt
of this letter. If you have any questions regarding this matter, please feel free to call this office.
