Re: Case AV 89-7
Dear Mr. Gibson,
This letter is in follow-up to our conversation of 11 August 1989 in which I
opposed the granting of the administrative variance. I reside in the home to the
west of lot 26 and share a common wall on the property line with lot 26. The first
20’ of this wall is also, to my understanding, in violation of the single family
residence zoning laws.
Although I signed the original petition for a variance request on behalf of
M&V Redding, I did so only on the consideration of the money that they had
spent. However, at that time it was unknown that the front wall extended on city
property. Knowing about the encroachment and the city’s height restriction in the
first 20’, I do NOT wish a variance even for my portion of the common wall - I
wish compliance.
The Redding’s have not been upfront with the construction from the very
beginning. For example, the common wall was not to extend forward pass our
garage originally, then by their change it was not be over 2’ after they negotiated
with the contractor; currently it is over 6’ in the corner - I object.
The final design of the front wall has never been disclosed. I do not
believe the final product will enhance the area as so claimed. I object to the
encroachment on city property. This wall also blocks my view to the east. It
blocks the traffic coming from the east and creates a dangerous situation.
Sincerely,
D. M. KUBACKI
