Rancheros Dr., Ste. 2 San Marcos, CA 92069 SUBJECT: ADMINISTRATIVE VARIANCE NO. 89-09 - Request to construct a six foot high wall in the required twenty foot front yard setback of a single-family residence in an R-7 Zone. Dear Mr. Peltzer: The Planning Director has completed a review of your application for an Administrative Variance at 2464 La Costa Avenue. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance can be made and, therefore, APPROVES this request based on the following findings and conditions. Findinus: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone. The lot is located on a cutve of La Costa Avenue and eastbound traffic flash headlights into the residence at night as motorists round the turn in the road. The property is located on steep topography that limits the useable portions of the site. 2. The requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question because the rear portion of the lot slopes away from La Costa Avenue and the property contains no level, useable rear yard. The six foot high wall will help provide privacy for what little useable flat area the property has in the front yard. Also, excessive traffic noise on La Costa Avenue impacts the front living room portion of the house and the wall will help mitigate these noise impacts. La Costa Avenue contains many multi-family residential projects that have six foot high walls and fences on the property line along the street for side and rear yard privacy, and to mitigate traffic noise impacts along La Costa Avenue. The wall will help screen motorist’s headlights from flashing in the residence. 2075 Las Palrnas Drive - Carlsbad. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located because the property on the side, adjacent to the wall is lower in elevation relative to the subject lot, and the wall will not be visible from this abutting lot. The wall will be off-set in five places and will be landscaped along it's front edge, therefore the wall will not appear as a straight linear barrier when viewed from the street, and the landscaping will help buffer its visual impacts. 4. The granting of this variance will not adversely affect the comprehensive General Plan because a wall is a permitted accessory structure in an R-1 Zone and the noise attenuation benefit of the wall will implement the Noise Element of the General Plan. Conditions: 7) The wall shall not exceed a height of six feet measured from the exterior side of the wall facing La Costa Avenue. 2) Landscaping shall be placed along the front edge of the wall facing La Costa Avenue in accordance with exhibit "A on file in the Planning Department.
