Dear Mr. Mack,
During our conversation at your property last December, you wanted to know how the
Engineering Department determines if a front yard wall is hazardous to motorists and pedestrians.
I later spoke with the engineer who reviewed and commented on the wall and discovered that
the City has calculated standards to determine if a wall or any other barrier is obstructing the
sight distance of motorists exiting the property's driveway, or motorists driving along the
property's street frontage. If a wall does not conform to such standards, the City cannot and will
not grant a variance for such a wall.
Also during our conversation, you were curious to know if a complaint was filed with the City in
reference to your front yard wall. Code Enforcement informed me that two separate complaints
were filed, which ultimately required the City to take legal action on the matter. Staff has also
discovered that your wall is within the public right-of-way. If YOU choose to redesicln the wall to
42" or less within the Dublic riaht-of-wav, then vou must obtain an encroachment Dermit from the
Citv of Carlsbad Enclineerina Deoartment.
I am sorry that your variance has been denied, but staff found it difficult to make the findings
necessary to grant a variance for your wall.
