SUBJECT: ADMINISTRATIVE VARIANCE 90-2 Request for an eight foot high chain link fence along the western most property line and along a section of the southern property line
Dear Mr. Spiers:
The Planning Director has completed a review of your application for an Administrative Variance at 2603 Jefferson Street. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance can be made and, therefore, APPROVES this request based on the following findings and conditions.
FINDINGS:
1. That there are exceptional circumstances and'conditions applicable to the property
that does not generally apply to other property in the same vicinity. The property has experienced a high occurrence of trespassing, theft and vandalism.
2. That such variance is necessary for the preservation and enjoyment of the
property right of protection possessed by other property in the same vicinity and
zone but is denied to the property in question.
3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely affect the comprehensive general plan.
You have the right to appeal this decision to the Planning Commission within ten days of receipt of this letter. If you have any questions regarding this matter, please feel free
