SUBJECX ADMINISTRATIVE VARIANCE NO. AV 93-03 - CAPELOUT0 RESIDENCE.
REMODEL - Request to reduce a front yard setback from 20 feet to 17 feet
on property located at 2448 Ocean Street in R-1 Zone in Local Facilities
Management Zone 1.
Dear Mr. Bedford:
The Planning Director has completed a review of your application for an Administrative
Variance, to reduce your front yard setback from 20' to 17' at 2448 Ocean Street. After
careful consideration of the circumstances surrounding this request, the Planning Director
has determined that the four findings' required for granting an Administrative Variance can
be made and, therefore, APPROVES this request based on the following findings and
conditions.
1. The following are exceptional circumstances applicable to the property that do not
apply generally to other properties in the same vicinity and zone:
The lot's unusual pie shape restricts construction potential of the building
footprint to an irregular design rather than the standard rectangular shaped
home.
The subject site also contains twice the setback or undevelopable area as
other properties in the neighborhood. The front yard setback encompasses
231 8 square feet or 38 percent of the lot. In comparison, the front yard
setbacks of rectangular lots in the area encompass between 1,000 to 1,500
square feet or 15 to 20 percent of the lot.
The subject lot is also substandard in size in comparison with other homes
in the same zone. The existing lot size of 6,534 square feet was created
before a minimum lot size of 7,500 square feet became required in the R-1
Zone. The smaller lot size increases the difficulty in developing a home on
this property.

The requested variance is necessary for the presemtion and enjoyment of a
substantial property right possessed by other properties in the same vicinity and
zone. With a few exceptions, other properties in the area have the common
rectangular shape found in most residential lots. These lots enable the owners to
build their houses without the same complications as the lot under review. A larger
percentage of each of these lots is developable due to fewer setback constraints and
their standard rectangular shapes.
The granting of this variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in the vicinity and zone in which the
property is located because only a small portion of the building will encroach into
an oversized front yard setback. The proposed addition will also blend with the
existing building's architecture and no unsafe situations will be created.
The granting of this variance will not adversely affect the comprehensive General
Plan. The General Plan is a Citywide plan which guides the City's growth and landuses into the future through a series of goal, objective, and policy statements.
A variation to zoning standards on a single residential lot is insignificant in
relationship to the development plan of the City. The reduced setback is also
consistent with all General Plan Elements.
This decision may be appealed by you or any- member of the. public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in writing
to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment
of $120.00. The filing of such appeal within such time limit shall stay the effective date
of the order of the Planning Director until such time as a final decision on the appeal is
