Dear Ms. Erickson:
The Planning Director has completed a review of you, application for an Administrative
Variance, for the reduction of panhandle driveway widths at the entry points of driveways from 14' to 12' and 20' to 16' to allow the subdivision of three single family panhandle lots
at 3800 Alder Avenue. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting
an Administrative Variance can be pde and, therefore, MPROW this request based on
the following findings and conditions.
1. There are exceptional or extraordinary conditions applicable to the property that do
not apply generally to other property in the same vicinity and zone due to the 2.26
acre parcel's frontages on El Camino Real and at the end of a cul-de-sac with limited
frontage. En accordance with City policies and standards, access rights from El
Camino Real will be relinquished as a condition of subdivision approval
necessitating access from, the Alder cul-de-sac. Although the developable acreage
of the parcel would allow a maximum of 4 lots, the limited frontage reduces access opportunities to the parcel. Three lots ranging in size from 29,000 square feet to
51,000 square feet, each receiving access from a panhandle driveway, can be created
if panhandle driveway widths are reduced to 12' from the required 14' for a single
panhandle access and to 16' from the required 20' (for the first 10') of a dual panhandle access. Driveway width reductions are! necessitated by the limited
frontage area and by City driveway design and spacing standards.
2. The Administrative Variance to reduce driveway widths is necessary to preserve a
substantial property right possessed by other property in the vicinity since other
smaller parcels with wider fiontages on the cul-de-sac and similar constraints have subdivided into standard and/or panhandle lots similar in size and density to those proposed by this subdivision. Due to the parcel's very limited frontage, without a
variance to minimally reduce the driveway widths at the street entries, subdivision
into three parcels cannot be achieved. Density based upon developable acreage and
the R-1-15 zoning would allow 4 lots, however, the limited frontage restricts
development to three lots with a variance.

3. The reduction of driveway widths providing access to the proposed lots will not be
materially detrimental to the public welfare or injurious to surrounding properties
or improvements since the driveway widths allow adequate width for fire and utility
truck access. The reduced driveway widths do not affect the provision of street and
utility improvements in accordance with City standards.
4. The granting of the variance is consistent with the General Plan since the reduced panhandle driveway widths will allow the infill parcel to subdivide into single family lots which are consistent with densities permitted in the RLM designation as well
as the R-1-15 zoning requiring 15,000 square foot minimum lots. The project which
limits disturbance to the flatter area of the lot is also consistent with the Mello II
Local Coastal Program restricting development on 25%+ slopes.
1. Approval of AV 94-02 is granted subject to the approval of MS 93-02, HDP 93-03
and SUP 93-01.
2. Approval is granted for AV 94-02, as shown on Exhibit "A", dated June 16, 1994, incorporated by reference and on file in the Planning Department. Development
shall occur substantially as shown unless otherwise noted in these conditions.
This decision may be appealed by you or any member of the public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in writing
to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment
of $470.00. The filing of such appeal within such time limit shall stay the effective date
of the order of the Planning Director until such time as a final decision on the appeal is reached. If you have' any questions regarding this matter, please feel free to contact Anne
