We are officially withdrawing our request for the Phase 5 rear yard encroachment. We've reviewed the responses from the homeowners at Fairways and have reviewed our site plan and feel that we can accommodate our needs within the normal building setbacks and, therefore do not require any administrative variance for this phase. It is our intention to continue to seek the administrative variance for Phase 4, Lots 57 thru 78. We recognize that lot 48, in Phase 4, is not eligible for an administrative variance, as the rear yard does not front on open space. Hence this would not be a part of the administrative variance approval. I trust that after receiving this letter, you will be able to modify our request for administrative variance to cover only Phase 4 as described above. I would appreciate it if you could respond back to me as soon as possible in order for us to clarify this situation with our sales and construction staff, as well as those buyers who are currently in escrow to purchase a home.
