DescriptionExplanation.
The Fairways project is a 149-lot single family subdivision located just north of the La Costa
golf course and just southeast of Alicante Road and El Fuerte Street. There are' four different
house plans for the project, three being 2-story and one being shgle story. Approximately 213
of the project is built-out or currently under construction.
The administrative variances being applied for here relate to Phases IV and V; Phase IV is
currently under construction with Phase V to follow later this year or early next year. Several
of the lots have rear yards backing to open space, and pursuant to Section 21.46.120 (7) of the
Carlsbad zoning ordinance, are eligible for an administrative variance allowing encroachments
of unenclosed balconies, patios and decks into the required rear yard setback area.
The developer, FieldstoneLa Costa is requesting an administrative variance at this time, for lots
57-78 and 135-146 (not including open space lots 60, 68). . The variance would allow for
encroachments into the rear yard as described above. In prior conversations with planning
personnel, it was stated that the approval of this variance would be contingent upon rear yard
structures not encroaching into the 5 foot side yard setback, and that a minimum rear yard area
of 225 square feet be maintained.

All of the properties abut permanent open space areas. Additionally,
adjacent to those areas are streets, other open space areas, and/or a golf
course. The other properties in the area generally have rear ya-rds which
abut the rear yard of other residential properties.
2. Explain why such variance is necessary for the preservation and enjoymenr of a substantial
property right possessed by other property in the same vicinity and zone but which is denied to the property in question:
The properties in question do.not have sufficient rear yard area to build
a deck or balcony without encroachment into the required rear yard. These
decks and balconies are to be built to take advantage of extraordinary views
which are important assets to these properties.
3. Explain why the granting of such variance will not be materially detrimental to the public - welfare or injurious to the property or improvements in such vicinity and zone in which the .. property is located: ..
