Subject: AV 98-02 - Worth Condo Conversion
Dear Van;
In response to your letter dated September 10, 1998 and the letter from Gary E. Wayne,
Assistant Planning Director, this letter shall expand my hand written letter of August 21,
1998 and provide the reasons for my appeal of the Planning Director’s denial.
1. There Planning Director was in error in not granting this requested variance
because he was unaware of the exceptional and extraordinary circumstances and
conditions that apply to the subject property. The CC&Rs for the Bristol Cove
development call for a 30 foot rear yard set back for this property. In addition, this lot is
10 to 15 feet shorter than the average lot in the Bristol Cove subdivision. This is certainly
an extraordinary situation within the immediate area and very extraordinary when compare
to other areas of the City where the strict enforcement of the PUD would be less
detrimental to the property. There is ample room for resident and visitor parking in
tandem with the removal of 3 feet of the entry landing. This will allow for 2 full size, 20
foot parking spaces to be provided in tandem without overlapping the sidewalk.
2. Denial of the requested variance would negatively impact the enjoyment of
substantial property rights because similar variances have been granted to other property
owners with less extraordinary circumstances in the same vicinity and zone.
3. The granting of this variance would not be material detrimental to the public
welfare or injurious to the property or improvement in the vicinity because there is ample
room to park 2 vehicles in tandem without obstructing the public sidewalk. In addition,
due to the location within the Bristol Cove area, there is ample on-street parking because
there is no access by residential units to the opposite side of Park Drive. Guests would
not be tempted to park illegally.
4. The requested variance will not adversely affect the comprehensive General Plan.
Let me know when I am scheduled to present my appeal to the Planning Commission.
