1. Explain why there are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or class of use in
the same vicinity and zone:

Description/Explanation:
The Applicant owns various parcels along Chinquapin Avenue. In order to develop
these parcels, the City of Carlsbad has required certain street improvements on
Chinquapin Avenue including the dedication of additional street right-of-way
for future construction of a cul-de-sac. The dedication of this additional
right-of-way (recorded 1-15-99 Document No. 1999-0024586) across portions of
lots 5, 6, and 7 has resulted in a substantial reduction in the depth and areas
of Lots 5 and 6. The owner/Applicant would like to build on the remaining
6,054.84 square feet created by the Certificate of Compliance for adjustment
Plot 206-013-14, 206-013-15 ADJ 525, CE 824. Because of the reduced depth of
this consolidated lot, a house must be turned sideways to fit on the lot. It
would be extremely difficult to build a marketable house and meet the City of
Carlsbad's set back requirements.

The Owner/Applicant is requesting a variance in the front and rear yard set
back from twenty (20) feet to fifteen (15) feet. This would allow fifteen (15)
feet set backs in both front and rear yards and an average of sixteen (16) feet
six (6) inches the driveway (see EXHIBIT "B"). Other possibilities for a
variance are shown on EXHIBITS "C", l'D", and "E". * The overall effect would be
usable front and rear yards with minor variances on both sides that would not
have a negative effect on the overall street scene along Chinquapin Avenue.
