Dear Mr. Ponder:
This letter is in response to your request of the City’s position regarding coastal access facilities
for the Southland Communities project located on the northwestern and southwestern terminus of
Chinquapin Avenue in Carlsbad.
Exhibits “I” and “J” of the Agua Hedionda segment of the Local Coastal Prograrn identifies bike
and pedestrian route segments traversing along the northern shore of Agua Hedionda Lagoon
between Carlsbad Boulevard and the railroad tracks. This segment appears to be south of the
property in question and on the San Diego Gas and Electric property which fronts the lagoon.
There exists an unimproved trail currently used by the public which also connects with the
segment provided with the Hubb’s fish hatchery.
Exhibit “K” references two vista points in the vicinity of the project site. The first is along
Garfield Street, across from Date Avenue, at a point that overlooks the Agua Hedionda Lagoon
and the other is other is on the western terminus of Chinquapin Avenue. Chinquapin Avenue
will not be constructed through to Carlsbad Boulevard and the remaining public right-of-way
will be retained by the City of Carlsbad. This site has the opportunity to provide a coastal vista
point that by being located above Carlsbad Boulevard will provide a 180 degree view of the
coastline. The applicant approached the Parks Department regarding the improvement of the
property for open space/passive recreation purposes. The City is not willing to accept
responsibility at this time to provide maintenance of a park of this small size. Again, the City
will maintain the public right-of-way of Chinquapin Avenue fkom the proposed cul-de-sac bulb
to Carlsbad Boulevard.
The applications for development by Southland Communities lay to the north and south of
Chinquapin Avenue and will not bias the vista point nor the bike and pedestrian trial segments.

In regards to the expansiveness and preservation of vista points, neither the policy statements of
the LCP nor the Scenic Preservation Overlay Zone of the City of Carlsbad Zoning Ordinance
(Section 21.40) contain definitive criteria regarding these items. The LCP and overlay zone do
not contain view quantifiers, they only identify the protection, maintenance, and maximizing of
scenic resources.
