SUBJECT: AV 99-04 - Granada Villas Retaining Wall
The Planning Director has completed a review of your application for an Administrative
Variance to allow a seven foot eight inch retaining wall, AV 99-04 Granada Villas Retaining
Wall. After careful consideration of the circumstances surrounding this request, the Planning
Director has determined that the findings required for grantingqan Administrative Variance CAN
be made and therefore, APPROVES this request based on the following findings and
conditions.
Findinas:
1. That special circumstances apply to the subject property in that the retaining wall. is
necessary to direct drainage away from adjacent properties and down Lewis Lane, such
that the strict application of the zoning ordinance deprives said property of privileges
enjoyed by other property in the vicinity and under the identical zoning classification.
2. That the variance is subject to conditions which will assure that the adjustment(s)
thereby authorized will not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which the subject property is
situated.
This decision may be appealed by you or any member of the public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the
Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment of $400.
The filing of such appeal within such time limit shall stay the effective date of the order of the
Planning Director until such time as a final decision on the appeal is reached. If you have any
