This letter is in regard to your request to park a boat in your front yard setback,
pursuant to section 21.44.060 of the Carlsbad Municipal Code. A letter was mailed to
you February 29, 2000, requesting mailing labels and postage, so that we could notice
the property owners within a 300 foot radius of your property, as required by the
Municipal Code. We have not received the requested labels and the code violation on
your property remains active. If you have not received this letter, please contact us
immediately, so we may send you a copy.
If you have made other arrangements for storing your boat and no longer wish to
pursue this variance, please submit a written statement to that effect to our office
immediately. If you do not withdraw your request in writing or provide us with the
mailing labels requested, code enforcement proceedings will continue.

Dear Mr. Montomery:
The following is in regard to your above referenced request, which is currently under
review. As required by section 21.44.060(c) and 21 51.040 of the Carlsbad Municipal
Code, public noticing is required in order to approve your request. Please find attached
copies of these code sections and the noticing package requirements, which should be
submitted to our office as soon as possible.
Please include with your submittal payment for postage at 33 cents per label. As stated
in the attached requirements, please provide adhesive mailing labels with the type-
written address in the exact format requested. Do NOT send envelopes.
The Planning Director will render his decision no sooner than 15 days from the date of
the mailing.
If you no longer park your recreational vehicle in your front yard setback and do not
wish to pursue this variance, please provide a written statement to our office, so that we
may remove your violation from Code Enforcement's records.

Dear Mr. Holzmiller,
In response to the issues stated in the letter from Code Enforcement Officer Gene Kellogg dated
October 18, 1999, I request a variance to allow a boat and trailer to partially extend into the
front yard setback. Currently I own a 21' boat and trailer which is parked on a concrete area
adjacent to the driveway and garage. Though a majority of the boat and trailer are within the
sideyard setback, a portion does extend into the front yard setback.
According to section 21.44.060 (2)(C)(i) the Planning Director shall consider whether parking
in or access to the side yard would require the removal of significant landscaping. I am the
father of five children who daily use the specific side yard area in question. The grass
landscaping in the side yard is significant to our family. The reason for this use is due to the
configuration of our property: the slope that extends down from Arenal Road effectively chokes
off the rear yard; thus the side yard is used like a rear yard for a play area. Placing the boat
in this area would remove the very reason for the purchase of this home for a family of our size.
Though not ideal, the majority of the boat is tucked away adjacent to the garage. I have
consciously tried to minimize the impacts of the boat by the following: 1) A landscape hedge
4'-5' in height was grown on one side to hide the boat from the adjacent neighbor. 2) A liquid
amber tree was planted directly in front of the boat to allow some screening from the street.
I am hopeful that you will find the aforementioned arguments suitable to grant the requested
variance.

1. Please submit the following plans:
A) One 8%" x 1 1" copy of your reduced site plan, showing proposed
boat parking location and distance from boat to the side and front
property lines. These copies must be of a quality which is
photographically reproducible.
2. As required by Section 65091 of the California Government Code, please
submit the following information needed for noticing and sign the enclosed
form:
A) 300' Owners List - a typewritten list of names and addresses of all
property owners within a 300 foot radius of the subject property,
including the applicant and/or owner. The list shall include the San
Diego County Assessor's parcel number from the latest equalized
assessment rolls.
B) Mailing Labels - two (2) separate sets of mailing labels of the
PROPERTY OWNERS within a 300 foot radius of the subject property.
The list must be typed in all CAPITAL LETTERS, left justified, void of
any punctuation. For any address other than a single family residence,
an apartment or suite number must be included but the Apartment,
Suite and/or Building Number must NOT appear in the street address
line. DO NOT type assessor's parcel number on labels. DO NOT
provide addressed envelopes - PROVIDE LABELS ONLY. Acceptable
fonts are: Arial 11 pt, Arial Rounded MT Bold 9 pt, Courier 14 pt, Courier
New 1 I pt, and MS Line Draw 11 pt. Sample labels are as follows:

C) Radius Map - a map to scale, not less than 1" = ZOO', showing all
lots entirely and partially within 300 feet of the exterior boundaries of
the subject property. Each of these lots should be consecutively
numbered and correspond with the property owner's list.
D) Fee - a fee shall be paid for covering the cost of mailing notices. Such
fee shall equal the current postage rate times the total number of
labels. Cash check (payable to the City of Carlsbad) and credit cards
are accepted.
I HEREBY CERTIFY THAT THE PROPERTY OWNERS LIST AND LABELS
SUBMITTED TO THE CITY OF CARLSBAD ON THIS DATE REPRESENT THE
LATEST AVAILABLE INFORMATION FROM THE EQUALIZED ASSESSOR'S ROLES.

REQUIREMENTS LOCATED AT 1855 LOTUS COURT
It has come to our attention that there is a boat and trailer being stored on
concrete next to the driveway in the front yard setback at the above
referenced location. This vehicle is being stored in violation of Carlsbad
Municipal Code, Section 21.44.060. Please find a copy of this code section
attached for your reference.
Please park or store your recreational vehicle in accordance with the above
referenced municipal code section. A reinspection will be conducted on or
about November 1, 1999, to ensure compliance. .
We anticipate and appreciate your cooperation regarding this matter. Please
