Dear Mr. Everson:
I have reviewed your requesf: for a reduced sideyard setback at.3410 Santa Clara
Way. Under regulations of the R-1 Zone in the Carlsbad Zoning Ordinance the
sideyard setback on an interior lot is 10% of the lot width, not to be less than
5', however, not needing to exceed 10'. The lot width of your house is 90' thus
a 9' setback is required by strict interpretation of the ordinance.
The R-1 Zone, however, does provide for reduction of the sideyard setback by
cumstances include extreme topographical features. It was found that such cir-
cumstances do exist on your-lot in that your house stands on fill material and
its foundation is. approximately -10 to 15 feet higher than the adjacent.properfy,

As per section 21.10.040 A(3), I find that the sideyard setback on the south side
of lot 46 of Carlsbad Tract 76-2 need not be greater than 5', however, the opposite
sideyard on your property must be at least 10'. Your building permits will be
processed based on this determination.
