Re: Determination of a Reduced Sideyard Setback at 3057 Hiuhland Drive (156-190-35)
I have reviewed your request for a reduced sideyard setback.
Under the provisions of the R-1 Zone in the Carlsbad Zoning
Ordinance, the sideyard setback on an interior lot is 10%
of the lot width, not to be less than 5'; however, not
needing to exceed 10'. The lot width of your house is 75',
thus a 7.5' setback is required by strict interpretation of
the ordinance.
The R-1 Zone, however, does provide for reduction of. the
sideyard setback requirement by Planning Director approval.""'
Upon review of your,plan, the following findings were made:
1. The proposed detached structure cannot be
placed so as t-o meet-the requirements of the Carlsbad Zoning Ordinance.
2. The proposed structure cannot be easily
attached to the main building due to the sloping driveway.
3. The adjacent property has an existing structure which is set back over 25' from the common property line. The owner has been notified and is aware that he
will not be allowed a similar reduced side
setback on that side.
As per Section 21.10.040 A(2), I find that the sideyard
setback on the north side of the lot located at 3057
Highland Avenue need not be greater than 5'; however, the
south sideyard on the lot must be at least 10'. Your building plans must be revised to meet these requirements.
