The proposed modifications include: • Minor architectural design changes to Building Eleven in keeping with the overall design theme of the center to suit the proposed tenant. • Minor building position change to widen the drive thru lane by two feet. • Modifications to the drive thru feature by moving the porte cochere from the midpoint of the west building elevation towards the south end of the west elevation • Decrease the height of the main flat architectural roof parapet element by five feet (from 25 feet to 20 feet). • The elimination of a 43 foot tall tower element. The building now incorporates three lower tiled roof tower elements on three of the four building elevations. • Decrease the main building store front entry feature height from 33 feet to 27 feet 4 inches. • The building area remains the same at 4,500 square feet. In order for o Discretionary Permit Consistency Determination to be approved, all af the following findings must be made: 1} No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood. 3} The proposed revision does not change the density or boundary of the subject property. 4} The proposed revision does not involve the addition of a new land use not shown on the original permit. 5} The proposed revision does not rearrange the major land uses within the development. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code. 7} The proposed change will not result in any significant environmental impact, and/or require additional mitigation. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determination With the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35. Please find attached a copy of the approved plan stamped "Consistency Determination," and signed by the City Planner.
