Suite A-203 2900 Bristol Costa Mesa, CA 92626 SUBJECT: CONSISTENCY DETERMINATION - CD 14-06/CUP 13-09 - ICETOWN SKATEOPLEX The City Planner has completed a review of your application for a Consistency Determination for the property located at 2283 Cosmos Court, (APN: 203-051-03) which is a modification to Icetown Skateoplex CUP 13-09 to enlarge a 565 square foot equipment enclosure with 12 foot tall block walls to 747 square feet with eight foot tall staggered split block walls. The proposed modifications include: • Revision of Exterior Equipment Area - The original project approval included a 565 square foot equipment area enclosed by 12 foot tall block walls. Due to a change of ice rink equipment, the chiller units are needed to be located outside the building. In order to accommodate the chiller units, the equipment enclosure will need to be expanded to 747 square feet and the wall heights will be reduced to eight feet tall to allow for air circulation between the two units which are 7' 4" tall. In addition, a concrete pad will need to be constructed on the existing service ramp to provide a level surface for the chiller units. Lastly, the split face block wall enclosing the Zamboni room has been increased from 12 feet tall to 20 feet tall. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2) The request represents an upgrade in overall design features and or materials and improves upon the projects compatibility with the surrounding neighborhood. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8) The proposed change would not result in any health, safety or welfare impacts. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35. Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file and a reproducible 24" X 36" mylar copy of the amended site plan. The mylar must be submitted, stamped "Consistency Determination," and signed by the City Planner prior to issuance of any building permits for the project. The Consistency Determination Title Block stamp, and other Title Block stamps, can be downloaded from the City's website at http://www.carlsbadca.gov/services/departments/planning/Pages/applications.aspx.
