SUBJECT: CD 14-07 - LA COSTA TOWN SQUARE BANK OF AMERICA - (SDP 01-04/CUP 08-04)
The City Planner has completed a review of your application for a Consistency Determination, (APN:
223-050-72-00), which is a modification to the architectural design of the original project Building 6,
now Building 4 (3428 Via Mercato), within the La Costa Town Square Shopping Center. The proposed
modifications include:
• IVIinor architectural design changes to Building Four in keeping with the overall design
theme of the center to suit the proposed tenant.
• Modifications to the drive thru feature from a covered arch entry under a gable roof to an
attached flat roof canopy. The drive thru feature is located between the building and
Rancho Santa Fe Road but will not be readily visible from the roadway or the commercial
center.
• The roof elevations changes by raising the lowest roof by 2 feet (from 22 feet to 24 feet) and
lowering the highest roof by 2 feet (from 36 feet to 34 feet). The building's middle roof
elevation changes from a sloped tile roof to a flat parapet roof element. The project
maintains the tiled roof corner element.
• Decrease in the building area from 4,000 square feet to 3,171 square feet.
• The site plan generally follows the site design and building layout approved by CD 13-16.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following
findings must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function.
2) The request represents an upgrade in overall design features and or materials and improves
upon the project's compatibility with the surrounding neighborhood.
3) The proposed revision does not change the density or boundary of the subject property.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code.

7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8) The proposed change would not result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project which
would be exacerbated with the proposed change.
10) The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.

Dear Mr. Lynch:
Bank of America is proposing to build a new 3,718 SF banking center with drive thru lanes on the north
side of La Costa Town Square Center along Rancho Santa Fe.
The design ofthe exterior elevations is based on the approved design standard that was submitted by
SCA. Architect of the Center.
A minor modification ofthe exterior elevations from the approved master plan had been made due to
the Bank of America prototypical plans.
Following are the revisions:
-New entrance to the main building and accessibility parking stalls are now facing south side for more
visibility to the customers and patronage ofthe Center.
-Footprint ofthe building has changed from larger size to smaller size.
-Location of fire riser and electrical closet are re-located on the northwest corner ofthe building.
-Drive-Up canopy has been detached from the main building.
All architectural design elements are kept to match the Center.
The purpose of this letter is to submit for Consistency Determination Submittal Procedures and
Application to get an approval from Planning, prior to submitting our construction documents to the
City.
