The Commission voted 6-0 (Compas Absent) to APPROVE your request. The decision of the Planning Commission became final on June 6, 2001. The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code 1.16. These items are listed below: 1. Please provide a soils investigation conducted by a licensed soils engineer which determines that the subject slope is stable and development impacts are mitigatable for at least 75 years or the life of the structure. 2. Please provide an exhibit which clearly illustrates the stringline setback at the rear of the property from the adjacent structures. Please note, if your proposed rear patio is to be covered by an extending the roof of the main structure, then the patio is considered a part of the main structure and must fall behind the stringline of the two adjacent structures. However, for this to occur, you must submit the additional items listed below. If the required items are not received by February 8, 2001, your project will be rescheduled for a later hearing. In the event the scheduled hearing date is the last available date for the City to comply with the Permit Streamlining Act, and the required items listed below have not been submitted, the project will be scheduled for denial. 1. Please submit the following plans: A) 10 copies of your (site plans, landscape plans, building elevation plans, floor plans) on 24" x 36" sheets of paper, stapled in complete sets folded into BVz' x 11" size. B) One 81/2" x 11" copy of your reduced site plan, building elevation and floor plans. These copies must be of a quality which is photographically reproducible. Only essential data should be included on plans. 2. As required by Section 65091 of the, California Government Code, please submit the following information needed for noticing and sign the enclosed form: A) 600' Owners List - a typewritten list of names and addresses of all property owners within a 600 foot radius of the subject property, including the applicant and/or owner. The list shall include the San Diego County Assessor's parcel number from the latest equalized assessment rolls. The scale of the map may be reduced to a scale acceptable to the Planning Director if the required scale is impractical. E) Fee - a fee shall be paid for covering the cost of mailing notices. Such fee shall equal the current postage rate times the total number of labels. Cash check (payable to the City of Carlsbad) and credit cards are accepted. Engineering staff does not have any comments to add to the project. Please add the following conditions of approval to the approving resolution: 1. If the proposed development exceeds a building valuation of $75,000 as determined by the City Building Department at the time of issuance of building permit, developer shall cause property owner to enter into a "Neighborhood Improvement Agreement" with the City for the future public improvement of sidewalk and undergrounding or relocation of utilities prior to the issuance of building permit. Any proposed alternative method of securing the installation of improvements is subject to the discretion of the City Engineer. 2. Developer shall cause property owner to execute and submit to the City Engineer for recordation the City's standard form Drainage Hold Harmless Agreement regarding drainage across the adjacent property. 3. Prior to approval of any grading or building permits for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1, on a form provided by the City Engineer.
