The Commission voted 6-0 (Nielsen Absent) to APPROVE your request. The decision of the Planning Commission became final on October 3, 2001. The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. Engineering staff does not have any comments to add to the project. Please add the following conditions of approval to the approving resolution: NOTE: Unless specifically stated in the condition, all of the following conditions, upon the approval of this proposed tentative map, must be met prior to approval of a building permit. General 1. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, Developer shall apply for and obtain approval from, the City Engineer for the proposed haul route. 2. Prior to issuance of any building permit, Developer shall comply with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. Fees/Agreements 3. Prior to approval of any grading or building permit for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1, on a form provided by the City Engineer. Grading 4. Developer shall have the entire drainage system designed, submitted to and approved by the City Engineer, to ensure that runoff resulting from 10-year frequency storms of 6 hours and 24 hours duration under developed conditions, are equal to or less than the runoff from a storm of the same frequency and duration under existing developed conditions. Prior to issuance of building permits, Developer shall pay all fees, deposits, and charges for connection to public facilities. Developer shall pay the San Diego County Water Authority capacity charge(s) prior to issuance of Building Permits. 6. This project is approved upon the express condition that building permits will not be issued for the development of the subject property, unless the District Engineer has determined that adequate water and sewer facilities are available at the time of occupancy. The application and plans submitted for this proposed project are currently incomplete and unsuitable for further review due to the following incomplete items: 1. A preliminary title report current within the last 6 months. The following issues need to be resolved prior to resubmittal: 2. It appears that one site plan could be used instead of two. Please consolidate the information into one plan. Creating one plan will eliminate any inconsistences (i.e. setbacks. The cover sheet indicates a side yard set back of 7.5 feet. The other plan indicates 9 feet). 3. On the site plan: a. Show all on-site easements, including 1) the 10-foot wide private storm drain easement, 2) the drainage easement over the rear yard brow ditch, 3) the open space easement, and 4) any street easement dedications. b. Provide a summary table of information such as site acreage, lot coverage, net developable acreage, zoning etc. c. Provide a street cross section with dimensions. d. Clarify if the line crossing the driveway represents the private storm drain. e. Provide grading quantities, regardless of how minute they may be. f. Show the rear yard brow ditch. g. Do overhead power lines exist? If so, please show these facilities. 4. Provide a copy of the recorded map (MS 95-02, Map No. 18186.) for this project. 5. According to the improvement plans (DWG 339-3), curb, gutter and sidewalk were constructed along the project frontage. The site plan only indicates curb. Is there P.C.C. sidewalk along the property frontage? Please clarify on the site plan and dimension these improvements. 6. Provide a best management practice to filtrate storm water pollutants (i.e. driveway oils stains) from exiting the property. One method to consider is sloping the driveway to direct sheet flow drainage to the lawn drainage swale located on the north side of the driveway. 7. Will you be utilizing an existing drop inlet on the private storm drain? According to the grading plans it appears that a drop inlet was installed at the front of the property (DWG339-3A, PE2.94.12). 8. The driveway entrance must be located such that the curb height to driveway transition is 3 feet from an extension of the side property line. The transition itself must be 3 feet wide. Therefore, the driveway as measured at the front property line must be 6 feet from the side property line. Currently, the distance is 4 feet. Please revise the plans accordingly. 9. The Planning Department has reviewed your Coastal Development Permit, application no. CDP 01-001 - Gaitaud Residence, as to its completeness for processing. The application is incomplete, as submitted. Attached are two lists. The first list is information which must be submitted to complete your application. This list of items must be submitted directly to your staff planner by appointment. All list items must be submitted simultaneously and a copy of this list must be included with your submittals. No processing of your application can occur until the application is determined to be complete. The second list is issues of concern to staff. When all required materials are submitted the City has 30 days to make a determination of completeness. If the application is determined to be complete, processing for a decision on the application will be initiated. In addition, please note that you have six months from the date the application was initially filed, January 1, 2001, to either resubmit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed to constitute withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new application must be submitted. Engineering: Missing Preliminary Title Report ISSUES OF CONCERN Planning: 1. The side yard setbacks shown on the two separate site plans are inconsistent. Please provide just one site plan and clarify the side yard setbacks. 2. On the Title Sheet under the heading "Project Data", please provide the following information: zoning; general plan; lot coverage; required and proposed setbacks; building height; first floor, second floor and total living area and garage square footage. 3. Please provide separate sheets for the floor plans and elevations drawings; label the floor plans with first floor/second floor accordingly and clean up the plans by removing unnecessary comments/construction notes found on the floor plans and elevation drawings. Notes describing the roofing material, building exterior material, color, etc., should be shown on the elevation drawings. 4. Please remember that the proposed building plans will be reviewed and approved by the Planning Commission and therefore need to be clear and accurate. 5.
