SUBJECT: CDP 01-02(A) - PACIFICA PALOMAR OFFICE BUILDING
The Planning Department has completed a review of your application for a Coastal
Development Permit Extension, CDP 01-02(A) located adjacent and on. the south side of
Palomar Airport Road and east of Aviara Parkway in Local Facilities Management Zone 5. After
careful consideration of the circumstances surrounding this request, it has been determined that
there has been no change of circumstances in relation to coastal resources per Section 13169
of the California Code of Regulations since the original granting of the permit and that the
findings required for granting a Coastal Development Permit can be made and therefore,
APPROVES this request based on the following findings and conditions.
Findings:
1. That the proposed development is in conformance with the Certified Local Coastal
Program and all applicable policies in that the project complies with the relevant policies
of the Mello II Segment of the Local Coastal Program, the Coastal Agricultural Overlay
Zone, and the Coastal Resource Protection Overlay Zone in that no prime agricultural
lands exist on or near the site; no impacts will occur to environmentally sensitive
habitats; no coastal access is or will be needed through or adjacent to the project site;
and no significant public views points are on or near the site.
2. The project complies with the requirements of the Coastal Agricultural Overlay Zone as
the project has been conditioned to pay the agricultural conversion mitigation fee to
develop the property with uses other than agricultural uses.
3. The project also complies with the requirements of the Coastal Resource Protection
Overlay Zone as erosion will be controlled by grading in conformance with the City's
standards; grading will be restricted to the summer season unless winter grading is
required because of the presence of endangered species; the site contains no dual
criteria slopes; and the project will adhere to the City's Master drainage and Storm Water
Management Plan and Grading Ordinance to avoid increased runoff and soil erosion.
Conditions:
1. This Coastal Development Permit extension is valid for a period of two (2) years from
the project expiration date of September 19, 2003. If building permits for this project are

not obtained within this time period, the coastal development permit extension will expire
unless extended per Section 21.201.210 of the Zoning Ordinance.
2. This Coastal Development permit extension is subject to all of the conditions of approval
for CDP 01-02 contained in Planning Commission Resolution No. 5042.
This decision may be appealed by you or any member of the public to the Planning Commission
within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning
Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $440.00. The filing
of such appeal within such time limit shall stay the effective date of the order of the Planning
Director until such time as a final decision on the appeal is reached. If you have any questions

BUILDING
Pursuant to your letter of June 24* I want to respond to your inquiry about why permits have not been
pulled for the above referenced development project. First, Pacifica Enterprises continues to remain excited
about this development and we look forward to the day we will be able to proceed. However, due to the
downturn in market rates for class "A" office space we are compelled to hold off until the office market
recovers and stabilizes at an asking rate in the $2.25 p.s.f. full service gross. Therefore, we respectfully
request a three year extension to the Site Development Permit and the Coastal Development Permit. In the
mean time we are continuing to work with JRM Real Estate (the Kellys) regarding the off-site
improvement work along Laurel Tree Lane and Palomar Airport Road, and expect to have the all of the off-
site plans completed next week. We should be ready to submit the off-site plans to the City of Carlsbad in
the very near future.
Also enclosed herewith are two checks in the amount of $2,362.50 payable to the City of Carlsbad for the
Coastal Development Permit Extension and another check in the amount of $ 1,960.00 payable to the City
of Carlsbad for the SDP extension. Please contact me at 858 755 0216 in the event you need any further

RE: SDP 01-01 - PACIFICA PALOMAR OFFICE BUILDING
Dear Ms. Stevenson:
The Planning Commission approved the Pacifica Palomar project on September 19, 2001 by
Resolution 5041. The conditions of approval state that the project shall become null and void if
building permits are not issued within two years from the date of approval. The project will have
to be extended by an amendment to the Site Development Plan (SDP) permit to extend the
expiration date. The application must be made no sooner than 90 days or no less than 30 days
prior to the expiration date. The application fees for the amendment will be $1,960.00 for the
SDP and $2,362.50 for the Coastal Development Permit extension (25% of current fee and a
25% discount for multiple applications).
Please find attached the application form and a new disclosure statement that should
accompany the application. Please also provide a letter stating the reasons why building
permits have not been issued.
