P-1(B) Page 1 of 1 Revised 04/09 (^^^> CITY OF ^CARLSBAD Transportation Department www.carisbadca.gov SUBJECT: CARLSBAD BLVD ElVIERGENCY RIPRAP REPAIR CDP 10-05 - REGULAR CDP APPLICATION PROJECT BACKGROUND On March 17, 2010, the Planning Department issued a Notice of Decision regarding the issuance of an Emergency Coastal Development Permit (CDP) for three separate projects. The projects include the California Department of Parks & Recreation's (State) 6" Sewer Force Main and Sewer Lift Station Relocation, Encina Wastewater Authority's Sewer Outfall Pipe Line Protection, and Carlsbad Blvd Emergency Riprap Extension. The decision was to issue an Emergency CDP, which the City Council subsequently approved on March 23, 2010. As a follow up to the City's Carlsbad Blvd Riprap Extension project, being transmitted with this background is the regular CDP, which is required to be submitted within 30 days of issuance of the emergency CDP. City staff and Nolte Associates have prepared a riprap design to prevent further erosion to Carlsbad Blvd. The riprap design is the same design used for the Encina Creek Bridge Replacement project, CIP 3919 (CDP 09-08, SUP 09-03, and HMP 09-06). The Encina Wastewater Authority (EWA) has a 30 feet wide easement perpendicular to Carlsbad Blvd. The design does not show any riprap being installed within EWA's easement. When the City and EWA decide on a modified design that protects both the outfall and Carlsbad Blvd, it will be issued as a change order to the contract with the onsite Contractor. The riprap repair will begin at station 107+30 (the southern end ofthe riprap repair under the Encinas Creek Bridge replacement project) and extend south to station 110+08, which is just north ofthe State's existing sewer lift station. As part of the City's riprap extension project, a temporary sewer forcemain bypass will be installed aboveground, which will enable the contractor to remove the State's existing sewer forcemain that conflicts with the riprap improvements. The State has agreed to remove the temporary sewer forcemain bypass that will be located on the east side of southbound Carlsbad Blvd after they have installed their new sewer lift station and forcemain. Staff is currently working with the California Coastal Commission and Army Corp of Engineers (ACOE) regarding jurisdictional issues. In an effort to not delay the project by procuring an Emergency ACOE permit, the Contractor has been instructed to not perform work within ACOE jurisdiction. ACOE has jurisdiction under Section 10 of the Clean Water Act if work, such as installing sheet piles, constructing a berm, and excavating, is performed west of the Mean High Tide Line (4.60' Mean Lower Low Water). ACOE also has jurisdiction under Section 404 of the Clean Water Act if earthwork is performed west of the High Tide Line (7.65' Mean Lower Low Water). The Contractor will continue the use of the sheet piles east ofthe High Tide Line as used on the Las Encinas Creek Bridge Replacement project, to prevent the need for an Emergency ACOE permit. Emergency repairs, which would occur in an area south of the Encinas Creek bridge, are necessary as the area along Carlsbad Boulevard was undermined and exposed by severe storms which produced substantial rainfall, flooding and destructive tidal-surge wave action in this area. These events occurred on or about the same time as higher than normal tides produced by an astronomical high tide event. On February 2, 2010, during a routine inspection, City of Carlsbad staff determined that the roadway along Carlsbad Boulevard, south of the Encinas Creek Bridge had been compromised and the integrity of the roadway was at risk. Additionally, it was discovered that portions of the California Department of Parks & Recreation's 6" sewer force were exposed by the recent storm events, exacerbating the unsafe conditions of this area. Staff implemented protocols to ensure the safety of the motoring public, bicyclists, and pedestrians, and a local emergency was declared on February 5, 2010; this declaration has been subsequently extended by the City of Carlsbad City Council. The project description for the emergency permit follows. California Department of Parks & Recreation's 6" Sewer Force Main and Sewer Lift Station The California Department of Parks & Recreation's will relocate their sewer force main and sewer lift station from this area as part of this emergency CDP. If the California Department of Parks & Recreation is unable to relocate their sewer force main in a timely manner, the City will install a temporary sewer bypass line and remove this section of pipeline in order to install the 1635 Faraday Avenue, Carlsbad, CA 92008-7314 T (760) 602-4600 F (760) 602-8559 ® CDP 10-05 -CARLSBAD BOULEVARD RIPRAP EXTENSION March 17,2010 Page 2 riprap in this area. State Parks Department will relocate the remaining sewer force main and sewer lift station afterward. This will be determined in the field as work proceeds on both projects. The State has proposed to tie into the City's sewer force main to the south and east of the current location. Relocating this section of sewer force main will necessitate the removal of the sewer lift station that is located just to the south of the exposed line. The lift station will be demolished and a pre-fabricated lift station will be installed at the north end of the State campgrounds to the south of the project site. Encina Wastewater Authority's Sewer Outfall Pipe Line The Encina Wastewater Authority's (EWA) outfall sewer line is also located in this area. Though the outfall sewer line was not exposed by the storms, the outfall line is underneath where a section of riprap will be installed. The City attempted to locate the depth of the Encina outfall by potholing in the area, but the potholing did not uncover the outfall pipe. Excavation is required to expose the outfall pipe in order to make sure the installation of the riprap does not damage the outfall pipe from the weight of the riprap. Once the Encina outfall line is exposed, and its depth verified, then a modified riprap design will be prepared by the City and a design to protect the Encina outfall will be prepared by EWA. The location and protection of the outfall pipe line is part of this emergency permit and all work on this line will occur landward (east) of the Mean High Tide Line (MHTL). City of Carlsbad's Riprap Extension The northern end of the proposed riprap would start approximately 149 feet south of the Encinas Creek Bridge, which is where the southern end of the riprap will be installed under the Encinas Creek Bridge replacement project that started construction in January of this year (CDP 09-08, SUP 09-03, and HMP 09-06). Placement of riprap will extend southward an additional 280 feet, terminating just north of the California Department of Parks & Recreation's existing sewer lift station. There is some existing riprap in the area, which would be reconfigured and supplemented with an additional 1,434 cubic yards of 4-ton riprap, 1,174 cubic yards of 2-ton riprap, and 673 cubic yards of %-ton riprap on the west side of the roadway. The riprap design is the same as the design used for the Encina Creek Bridge replacement project. The design will need to be modified in the area 25 feet on both sides above the Encina VVastewater Treatment Plant outfall pipe to help protect the existing 48-inch diameter reinforced concrete pipe. The closed southbound lanes of Carlsbad Boulevard, just south of the Encinas Creek Bridge Replacement project site, will be used for all construction staging, including parking for contractors' equipment and vehicles. Excavation and backfill equipment will be stationed on the roadway above the bluff and not on the beach. Sheet piles will be required on the beach, just west of the bluff and east of the MHTL to prevent wave action in the area where the riprap will be installed. The sheet piles will be driven into the ground by either a drop hammer, or a vibratory hammer using a crane with the appropriate attachments. The crane is currently in the area completing work on the Encinas Bridge Repair project and will not have to be brought to this area. The contractor is not allowed to have any equipment west of the westerly sheet piles, nor store any material or equipment on the beach. Beach activity will be limited to installation of sheet piling, replacement and supplement of riprap, excavation of the outfall sewer pipe, installation of a protective cover over the outfall sewer pipe, and the removal of the sewer force main. CDP 10-05 -CARLSBAD ^ULEVARD RIPRAP EXTENSION March 17,2010 Paqe 3 The Planning Director APPROVES this request for an Emergency Coastal Development Permit based upon the following: Findings: 1. An emergency exists that requires action more quickly than permitted by the procedures for coastal development permits or for regular permits and the work can and will be completed by May 28, 2010 unless othenA/ise specified by the terms ofthe permit; 2. At its March 9, 2010 meeting, the City Council of the City of Carlsbad proclaimed the continuation of a declaration of a local emergency to repair/replace roadfill at Carlsbad Boulevard. The riprap extension permitted herein is in response to this declaration. 3. Public notice on the proposed emergency action has not occurred because time did not allow; and 4. The work proposed will be consistent with the requirements of the certified Local Coastal Program (LCP). The project site is located within the Mello II Segment of the Local Coastal Program and within the City's permit jurisdiction as the project has been designed to remain landward (easterly) of the mean high tide line, and thus outside of the California Coastal Commission's retained permit jurisdiction, however, within their appeal jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203), and the Coastal Shoreline Development Overlay Zone (Chapter 21.204) ofthe Carlsbad Municipal Code. The proposed project will comply with Mello II Policy 4-6 - "Sediment Control" Practices by adhering to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. No development is proposed in areas of steep coastal bluffs. The proposed project is consistent with the LCP in that the project will protect and stabilize the existing Carlsbad Boulevard southbound roadway and bike lane thereby ensuring access to the shoreline. In addition, the project will comply with Mello II Policy 7-13 - Visual Access by removing the existing above ground sewer lift station structure which will remove an obstruction to public ocean views. In addition, the relocated sewer pipelines will be installed underground, rip rap will be placed at or below existing road level, and the new lift station will be located in a vegetated area without direct ocean view. Therefore, the project will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. 5 This emergency project is statutorily exempt from the California Environmental Quality Act pursuantto CEQA Guidelines Section 15269. Conditions: 1. California Department of Parks & Recreation's 6" Sewer Force Main and Sewer Lift Station The California Department of Parks & Recreation's will relocate their sewer force main and sewer lift station from this area as part of this emergency CDP. If the California Department of Parks & Recreation is unable to relocate their sewer force main in a timely manner, the City will install a temporary sewer bypass line and remove this section of pipeline in order to install the CDP 10-05 -CARLSBAD BOULEVARD RIPRAP EXTENSION March 17, 2010 Page 2 riprap in this area. State Parks Department will relocate the remaining sewer force main and sewer lift station afterward. This will be determined in the field as work proceeds on both projects. The State has proposed to tie into the City's sewer force main to the south and east of the current location. Relocating this section of sewer force main will necessitate the removal of the sewer lift station that is located just to the south of the exposed line. The lift station will be demolished and a pre-fabricated lift station will be installed at the north end of the State campgrounds to the south of the project site. Encina Wastewater Authority's Sewer Outfall Pipe Line The Encina Wastewater Authority's (EWA) outfall sewer line is also located in this area. Though the outfall sewer line was not exposed by the storms, the outfall line is underneath where a section of riprap will be installed. The City attempted to locate the depth of the Encina outfall by potholing in the area, but the potholing did not uncover the outfall pipe. Excavation is required to expose the outfall pipe in order to make sure the installation of the riprap does not damage the outfall pipe from the weight of the riprap. Once the Encina outfall line is exposed, and its depth verified, then a modified riprap design will be prepared by the City and a design to protect the Encina outfall will be prepared by EWA. The location and protection of the outfall pipe line is part of this emergency permit and all work on this line will occur landward (east) of the Mean High Tide Line (MHTL). City of Carlsbad's Riprap Extension The northern end of the proposed riprap would start approximately 149 feet south of the Encinas Creek Bridge, which is where the southern end of the riprap will be installed under the Encinas Creek Bridge replacement project that started construction in January of this year (CDP 09-08, SUP 09-03, and HMP 09-06). Placement of riprap will extend southward an additional 280 feet, terminating just north of the California Department of Parks & Recreation's existing sewer lift station. There is some existing riprap in the area, which would be reconfigured and supplemented with an additional 1,434 cubic yards of 4-ton riprap, 1,174 cubic yards of 2-ton riprap, and 673 cubic yards of %-ton riprap on the west side of the roadway. The riprap design is the same as the design used for the Encina Creek Bridge replacement project. The design will need to be modified in the area 25 feet on both sides above the Encina Wastewater Treatment Plant outfall pipe to help protect the existing 48-inch diameter reinforced concrete pipe. The closed southbound lanes of Carlsbad Boulevard, just south of the Encinas Creek Bridge Replacement project site, will be used for all construction staging, including parking for contractors' equipment and vehicles. Excavation and backfill equipment will be stationed on the roadway above the bluff and not on the beach. Sheet piles will be required on the beach, just west of the bluff and east of the MHTL to prevent wave action in the area where the riprap will be installed. The sheet piles will be driven into the ground by either a drop hammer, or a vibratory hammer using a crane with the appropriate attachments. The crane is currently in the area completing work on the Encinas Bridge Repair project and will not have to be brought to this area. The contractor is not allowed to have any equipment west of the westerly sheet piles, nor store any material or equipment on the beach. Beach activity will be limited to installation of sheet piling, replacement and supplement of riprap, excavation of the outfall sewer pipe, installation of a protective cover over the outfall sewer pipe, and the removal of the sewer force main. CDP 10-05 -CARLSBAD BOULEVARD RIPRAP EXTENSION March 17, 2010 Page 3 The Planning Director APPROVES this request for an Emergency Coastal Development Permit based upon the following: Findings: 1. An emergency exists that requires action more quickly than permitted by the procedures for coastal development permits or for regular permits and the work can and will be completed by May 28, 2010 unless otherwise specified by the terms ofthe permit; 2. At its March 9, 2010 meeting, the City Council of the City of Carlsbad proclaimed the continuation of a declaration of a local emergency to repair/replace roadfill at Carlsbad Boulevard. The riprap extension permitted herein is in response to this declaration. 3. Public notice on the proposed emergency action has not occurred because time did not allow; and 4. The work proposed will be consistent with the requirements of the certified Local Coastal Program (LCP). The project site is located within the Mello II Segment of the Local Coastal Program and within the City's permit jurisdiction as the project has been designed to remain landward (easterly) of the mean high tide line, and thus outside of the California Coastal Commission's retained permit jurisdiction, however, within their appeal jurisdiction. The site is also located within and subject to the Coastal Resource Protection Overlay Zone (Chapter 21.203), and the Coastal Shoreline Development Overlay Zone (Chapter 21.204) ofthe Carlsbad Municipal Code. The proposed project will comply with Mello II Policy 4-6 - "Sediment Control" Practices by adhering to the City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water Mitigation Plan (SUSMP) and Jurisdictional Urban Runoff Management Program (JURMP) to avoid increased urban run-off, pollutants and soil erosion. The zone is intended to protect sensitive resources. It requires preservation of steep slopes with vegetation (dual-criteria slopes) with some exceptions. No development is proposed in areas of steep coastal bluffs. The proposed project is consistent with the LCP in that the project will protect and stabilize the existing Carlsbad Boulevard southbound roadway and bike lane thereby ensuring access to the shoreline. In addition, the project will comply with Mello II Policy 7-13 - Visual Access by removing the existing above ground sewer lift station structure which will remove an obstruction to public ocean views. In addition, the relocated sewer pipelines will be installed underground, rip rap will be placed at or below existing road level, and the new lift station will be located in a vegetated area without direct ocean view. Therefore, the project will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor othenwise damage the visual beauty of the coastal zone. 5 This emergency project is statutorily exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15269. Conditions: 1. (WEST) has completed the evaluation for Nolte and Associates, Inc. (Nolte) of the wave runup and riprap sizing for the west side of the Carlsbad Boulevard South bridge over Las Encinas Creek. The purpose of the study was to evaluate whether riprap was necessary along the shoreline adjacent to the culvert, and if so, to calculate the size and gradation of the riprap and the wave runup elevation. WEST conducted a site visit on August 10, 2009 to observe current conditions. Our evaluation found the existing riprap did not appear to have been installed according to standard practice. A filter fabric or inner riprap layer did not appear to be present. This inadequate installation and subsequent erosion processes may explain why some of the rocks have been transported a short distance down the beach slope towards the ocean. The concentration of road drainage at a few locations along the top of the bank also appears to have contributed to the bank erosion. Riprap protection is recommended for the proposed bridge based on our observations at the site, as well as computed riprap sizes greater than zero. The sections below summarize the riprap sizing and wave runup calculations, which are applicable to the reach between Carlsbad Boulevard South centerline stations 104+00 and 110+83. Riprap Sizing The U.S. Army Corps of Engineers' Coastal Engineering Manual (USAGE, 2006) was used to determine the riprap size based on coastal wave height. The equation to determine riprap weight is provided in the Coastal Engineering Manual Table VI-5- 22, (p. May 26, 2010 The design wave height was computed based on tides, wave setup, storm surge, and projected long- term sea level rise. The nearest tide gage is located in La Jolla, which recorded an extreme high tide of 5.5 feet NGVD on August 8, 1983 that includes storm surge. The U.S. Army Corps of Engineers State of the Coast Report for the San Diego Region (USAGE, 1991) recommends estimating sea level rise at 0.2 feet per 25 years, or 0.8 feet per 100 years. Wave setup values in the range of 0.5 to 1 feet have been referenced as reasonable estimates for the San Diego area. Combining the above values: Design Sea Level = 5.52 feet (extreme high tide)+ 1 foot (wave setup) + 0.8 feet (sea level rise over 100 years) = 7.32 feet NGVD. The proposed bridge is far enough up the beach that the design sea-state is depth limited, which means the depths are so shallow immediately offshore of the location of the revetment that the storm waves have broken and the larges waves are on flat offshore slopes (FHWA, 2008). For this condition, the Coastal Engineering Manual recommends a design wave height equal to eight tenths (0.8) of the depth at the toe of the structure. The elevation of the riprap toe is estimated to be approximately 3.2 feet NGVD. This is the point where the riprap slope, assumed at 1.5H: 1V, would intersect the beach at the toe ofthe revetment. Therefore, the design wave height is calculated as: H = 0.8 * (7.32-3.2) = 3.3 feet The calculated depth-limited wave height of 3.3 feet NGVD does not include allowances for beach erosion/scour processes. A minimum scour depth equal to the calculated wave height of 3.3 feet was assumed which equates to a total design wave height of H = 6.6 feet. The resulting rock size from the equation equals 2280 pounds—equivalent to Caltrans RSP Class 2-ton riprap with a minimum layer thickness of 5.4 feet. An inner layer of RSP Glass Vi-ton riprap with a minimum layer thickness of 3.3 feet, a backing layer of RSP Glass Backing No. 2 riprap with a minimum layer thickness of 1.25 feet, and RSP Fabric Type B are also recommended (Caltrans, 2000). Wave Runup Wave runup was calculated based on guidance in FHWA Hydraulic Engineering Circular No. 25 "Highways in the Coastal Environment" (2008), equation 6.4: Ru,2% / Hs = 1.6 r l^op vvith a maximum of 3.2 r Where: Ru,2% = runup level exceeded by 2% ofthe runups in an irregular sea Hs = Significant wave height near the toe of slope r = a roughness coefficient (r=0.55 for the stone revetments) fop = the siu-f similarity parameter, where fop = tan a / (2 n Hs / g Tp^)°^ a = slope angle Tp = wave period, peak period g = acceleration of gravity With a design wave height of 6.6 feet and a wave period of 14 seconds representative of San Diego winter storm conditions, the right side of the equation is greater than 3.2*r (=1.76), therefore the right side of the equation is set to 1.76. Adding this wave runup to the design water level of 7.32 feet NGVD results in a wave runup elevation of 18.9 feet NGVD. The elevation of the existing top of road is approximately 15 feet NGVD, so the wave runup is expected to overtop the road by several feet. Therefore, the riprap protection should continue from the toe all the way to the top of road. Summary and Recommendations A design sea level elevation of 7.32 feet NGVD was assumed based on the extreme high water of record equal to 5.52 feet NGVD (which includes storm surge), plus wave setup of 1 foot, plus long- term sea level rise of 0.8 feet. This design sea level elevation results in a depth-limited wave height of 3.3 feet at the estimated location (and elevation) of the riprap toe. When potential scour at the revetment toe is considered, the wave height doubles to a total design wave height of 6.6 feet. RSP Class 2-ton riprap with appropriate inner layers and filter fabric is recommended to prevent bank scour adjacent to the proposed bridge for extreme tide conditions. The Califomia Coastal Commission has suggested increasing the size of the outer layer to an intermixture of RSP Glass 2- ton and RSP Glass 4-ton riprap. The wave runup elevation was calculated to be 18.9 feet NGVD, which would overtop the existing road by several feet. Due to the approximate nature of the scour depth estimate of 3.3 feet used in the riprap sizing, WEST recommends adding a factor of safety for the burial depth of the riprap to account for potential scour. A safety factor of approximately 2 is recommended, resulting in a riprap toe burial depth of about 6.5 feet. One ofthe requirements of the riprap design is to limit the amount of riprap between the top of slope at Carlsbad Boulevard South and the ocean to a distance of 27 feet. The recommended placement of riprap to comply with this requirement is provided in Figure 1. A slope of 1H:1V was necessary for the inner riprap layers in order to maintain a 1.5H:1V slope for the outer layer. Additional riprap was included in the outer layer to account for potential riprap launching due to 6.5 feet of scour at the toe. There is a possibility that installation of riprap on a 1H:1V slope will present a challenge to the contractor placing the stone; however, the inner layers of riprap and the RSP filter fabric are necessary components of the riprap installation and should not be removed from the design. Furthermore, you must comply with the following non-discretionary Special Conditions: Special Conditions: 1. The pennitted activity shall not interfere with the right of the public to free navigation on all navigable waters of the United States as defined by 33 C.F.R. Part 329. 2. No earthwork is authorized by this Nationwide 14 permit confirmation other than what is shown in this confirmation. 3. Creosote treated pilings shall not be placed in navigable waters unless all of the following conditions are met: A) The project involves the repair of existing structures that were originally constructed using wood products; B) Hie creosote treated pilings are wrapped in plastic; C) Measures are taken to prevent damage to plastic wrapping from boat use. Such measures may include instailation of rub strips or bumpers; D) The plastic wrapping is sealed at all joints to prevent leakage; and E) The plastic material is expected to maintain its integrity for at least ten years, and plastic wrappings that develop holes or leaks must be repaired or replaced in a tnnely manner by the Permittee. 4. No other modifications or work shall occur to the structure permitted herein. 5. Temporary impacts of 0.004 acre of wetland for the Endnas Bridge project will be rrutigated through re-vegetation of native plant spedes to pre-construction conditions, as well as, the re-vegetation of newly bare areas ihat have been exposed due to tiie reduction -3- of the bridge. These areas shall be weeded quarterly for a minimum of 24 months after re- vegetation has taken place to prevent invasive plant species from dominating the site. 6. The Permittee shall discharge only clean construction materials suitable for use in the oceanic environment. The Permittee shall ensure no debris, soil, silt, sand, sawdust, rubbish, cement or concrete washings thereof, oil or petroleum products, from construction shall be allowed to enter into or placed where it may be washed by rainfall or runoff into waters of the United States. Upon completion of the project authorized herein, any and all excess material or debris shall be completely removed from the work area and disposed of in an appropriate upland site. 7. The Permittee shall notify the Corps Regulatory Division of tiie date of cormnencement of operations not less than 14 calendar days prior to commencing work, and shall notify the Corps of the date of completion of operations at least five calendar days prior to sudi completion. 8. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his auihorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers Regulatory Division, to remove, relocate, or alter tiie structural work or obstructions caused thereby, without expense to the United States. No daim shall be made against the Uruted States on account of any such removal or alteration. Cultural Resources: 1. Pursuant to 36 C.F.R. section 800.13, in the event of any discoveries during construction of either human remains, archeological deposits, or any other type of historic property, the Permittee shall notify the Corps' Archeology Staff witiiin 24 hours (Steve Dibble at 213-452- 3849 or John Killeen at 213-452-3861). The Permittee shall immediately suspend all work in any area(s) where potential cultural resources are discovered. San Diego Field Office 6010 Hidden Valley Road, Suite 105 San Diego, CA 92011-4213 SUBJECT: CARLSBAD BLVD EMERGENCY RIPRAP REPAIR - NWP 14 EXTENSION REQUEST On January 17, 2010, and for several days following, severe storms produced substantial rainfall, flooding and destructive extreme high tides in Carlsbad. These events occurred on or about the same time as higher than normal tides produced by an astronomical high tide event. On February 2, 2010, during a routine inspection. City of Carlsbad staff determined that the roadway along Carlsbad Boulevard, south of the Encinas Creek Bridge had been compromised and the integrity of the roadway was at risk. Staff implemented protocols to ensure the safety of the motoring public, bicyclists, and pedestrians, and a local emergency was declared on February 5, 2010. City staff and Nolte Associates have prepared a riprap design to prevent further erosion to Carlsbad Boulevard caused by extreme high tides. The riprap design is the same as the design used for the Las Encinas Creek Bridge Replacement project, CIP 3919 (CDP 09-08, SUP 09-03, and HMP 09-06). The Army Corps of Engineers (ACOE) has issued a Nation Wide Permit (NWP) 14 for Las Encinas Creek Bridge Replacement project (letter attached) and the City is requesting an extension of the previously issued permit. Although the sheet piles (western limits of work) will be installed about 8' landward from the high tide line, the ACOE has requested that the City seek an extension of NWP 14. The riprap design will need to be modified in the area 15 feet on both sides of the Encina Wastewater Treatment Plant outfall to help protect the existing 48-inch diameter reinforced concrete pipe. The riprap repair will begin at station 107+30 (the southern end of the riprap repair under the Encinas Creek Bridge replacement project) and extend south to station 110+08, which is just north of the State's existing sewer lift station. As part of the City's riprap extension project, a temporary sewer forcemain bypass will be installed aboveground, which will enable the contractor to remove the State's existing sewer forcemain that conflicts with the riprap improvements. The original CDP for the Encinas Creek Bridge replacement project stipulated that work shall be completed by May 28, 2010. In an effort expeditiously protect Carlsbad Boulevard from further damage and reopen both southbound lanes on Carlsbad Boulevard after May 28'^ we respectfully request a prompt issuance of NWP 14 extension so that the riprap design can be completed and necessary repairs, be made to increase the public's safety. City staff indicated that due to recent astronomical tides and storm waves, the existing force main sewer pipe, bluff, and Carlsbad Boulevard are no longer adequately protected by the existing revetment. As such, an emergency permit is currently being reviewed by the City and is scheduled for a City Council meeting on March 23"*, 2010. The emergency work will include moving existing dislodged rock into aligimient with the revetment, importing additional rock to supplement the existing revetment, and importing additional rock to create a new portion of revetment that does not currently exist. While it looks like there may be justification for an emergency permit, we do not agree with the City's position relative to permit jurisdiction. While we have not reviewed scaled plans, it appears that portions of the proposed repairs will occur below the Mean High Tide Line within the Coastal Commission's original permit jurisdiction. Recently, the Commission asserted jurisdiction over revetment maintenance activities directly north, and in line with the existing revetment (reference Coastal Development Permit # 6- 09-051), thus it can be expected that the Commission will also be asserting jurisdiction over the revetment work currently proposed. However, because the work is proposed under an emergency permit, the Commission will address the jurisdictional question when the City reviews/approves the required follow-up Regular Coastal Development Permit. Additionally, because the work proposed is considered temporary work to address an emergency situation,, it would be diligent of the City to limit the proposed emergency repairs to che minimal necessary and eliminate any work that cannot by modified in the future. Excavation is required on the west side of Carlsbad Boulevard to expose the outfall and complete the design. Once the Encina outfall line is exposed and its depth verified, then a modified rip rap design will be prepared by the City and a design to protect the Encina outfall will be prepared by Encina Wastewater Authority (EWA). The original CDP for the Encinas Creek Bridge replacement project stipulated that work shall be completed by May 28, 2010.
