The foliowing instructions should assist you in preparing the application form for submittal to the City: • Applications applied for: Check the appropriate boxes for the various application types for which you are applying. Check with counter staff to determine required application types needed to process your specific project. ^ Assessor Parcel No(s).: Include all assessor parcel numbers included within the project boundary. The counter staff can assist you in detemiining the appropriate assessor parcel number(s). ^ Project Name: Fill in the box with the name of the project, such as "Red Oak Homes" or "Benson Commercial." If no name is proposed, write the last name of the owner or applicant plus a brief description such as "Jones Condo Conversion" or "Smith Residential Subdivision." ^ Brief Description of Project: Write down a brief description of the project. Be specific but do not inciude square footage or architectural details. For example: a neighborhood commercial center with two restaurants; single family detached residential project; or an industrial/office complex with three industrial/office buildings. ^ Owner's Name, Address, Phone Number, Email address and Signature: To be filled in and signed by the owner for all applications. Use the owner's name as it appears on the title report. ^ Applicant's Name, Address, Phone Number, Email address and Signature: To be filled in and signed by the applicant. Fire Department/Water District Consultation: Prior to submittal of an application for development in the City, you are encouraged to consult with the Fire Department and the appropriate water district in order to design your project in compiiance with their requirements. Failure to consult with either agency could result in unnecessary delays, redesign or project denial. The purpose of the notice is to get projects to "design in" water and fire requirements in advance. A. SITE PLAN - Four (4) copies for a Minor Coastal Development Permit, four (4) copies for a Singie Family Regular Coastal Development Permit on 24" x 36" sheet(s). BUILDiNG ELEVATIONS AND FLOOR PLANS - Four (4) copies for a Minor Coastal Development Permit and four (4) copies a Single Family Regular Coastal Development Permit prepared on 24" x 36" sheet(s). Each building elevation and floor plan shall include the following information: 01. Location and size of storage areas. @2. All buildings, structures, wall and/or fences, signs and exterior lights. @3. Existing and proposed construction. H4. Provide documentation demonstrating compliance with City Council Policy 44 - Neighborhood Architectural Design Guidelines (if applicable). COLORED SITE PLAN AND ELEVATION PLAN - Not required with first submittal. It is the Applicant's responsibility to bring one (1) copy of a colored site plan and one (1) set of colored elevations to the Planning Department by 12:00 noon, eight (8) days prior to the Planning Commission meeting. Do not mount exhibits. II. REQUIRED DOCUMENTS AND SUBMITTAL ITEMS A completed Land Use Review Application Form. Completed Coastal Development Pemiit Application. Environmental Impact Assessment Part 1 with Regular Coastal Development Permits. III. SPECIFIC PROJECT REQUIREMENTS - (May apply to single family, regular and minor coastal development permits). Coastal Overlay Zones require additional information to be submitted as follows: (refer to the Municipal Code for a full description) 4 A. Coastal Agriculture Overiay Zone 1. Refer to the Carisbad Municipal Code Section 21.202.060 for specific requirements. B. Coastal Resource Protection Overlay Zone 1. Slope analysis/mapping for 25% and greater subject to Section 21.203.040 of the Carisbad Municipal Code. 2. Topographic and vegetation mapping/analysis subject to Subsection 21.203.040(B)(1) of the Carisbad Municipal Code, if project is located along the first row of lots bordering Buena Vista Lagoon including the lagoon mouth. 3. Topographic, drainage and wetland mapping subject to Subsections 21.203.040(B)(2)(a) and (b) of the Carlsbad Municipal Code if located east of Interstate 5 in the Batiquitos Lagoon watershed. 4. Drainage study subject to Subsection 21.203.040(B)(3) of the Carlsbad Municipal Code if project is located west of existing Paseo del Norte, west of Interstate 5 or along El Camino Real immediately upstream of existing storm drains. 5. Geologic report addressing landslides and slope stability subject to Subsection 21.203.040(B)(4) ofthe Carisbad Municipal Code. 6. Geologic report addressing landslides and seismic hazards subject to Subsection 21.203.040(C) and (D) ofthe Carisbad Municipal Code. . Coastal Shoreline Development Overiay Zone 1. Geotechnical report subject to 21.204.110 if project is located adjacent to an existing seabluff edge between the sea and the first public road parallel to the sea; also may be required by Planning Director if deemed necessary consistent with Section 21.204.110 of the Carisbad Municipal Code. 2. REQUIRED COASTAL PERMiT FINDINGS - Approval of a regular or minor coastal development permit is based on the ability to make three coastal related findings. These three findings are presented below for your review and information. 1. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies. 2. That the development is in conformity with the public access and public recreation policies of Chapter 3 of the Coastal Act. 3. That the development conforms with any applicable decision pertinent to this proposal and/or site as set by the Coastal Commission on a previously related appeals decision per Public Resources Code §30604(c). Include any details necessary to adequately explain the scope and/or operation of the proposed project. You may also include any background information and supporting statements regarding the reasons for, or appropriateness of, the application. Use an addendum sheet if necessary. Description/Explanation: The project proposes to construct a detached garage and laundry area on the ground floor, a 2"'' dwelling unit on the 2""^ floor with a roof deck above. The second dwelling unit will consist of 1 bedroom, 2 bathrooms, a living room and a kitchen area with interior stairs to access the roof deck. The design features and overall aesthetic will be substantially similar to the existing house located on the project site as well as the surrounding neighborhood. An existing garage and laundry will be completely demolished as a part of work, including all walls, roof and foundation. Existing) Site: The existing site is generally flat, draining from the front of the existing house towards the street, then aiso draining from the front of the house towards the rear of the property. The level of the rear yard is approximately 24" below the level of the front yard at its highest point. There is no soils report existing on the oroperty and we are currentiy in process of obtaining a soils report for building permit requirements. The scope of work performed for this investigation consisted ofthe following: • Review of published geologic maps and other background information, • Subsurface exploration, • Geotechnical analysis and preparation of this report containing my findings, conclusions and recommendations. For this investigation, I was provided with a set of building plans by Level 5 Design. PROPOSED CONSTRUCTION The proposed construction consists of a second dwelling, two-story, wood frame residence and garage. The residence will have a partial roof deck. The proposed residence will be constructed at the rear of the existing house. An existing garage will be demolished to make way for the new building. SITE DESCRIPTION The site is located in Carlsbad, Califomia as shown on the following Vicinity Map. The lot is a flat, rectangular, lot with an area of 0.16 acres. An existing, one-story residence is located at the front of the lot. Geotechnical Investigation for Proposed, Two-Story Residence 3555 Garfield Street Carlsbad, CA 92008 Page 2 Job No. 100812 August 26, 2010 VICINITY MAP SUBSURFACE EXPLORATION The subsurface exploration consisted of excavating two test borings with a hand auger to a depth of 8 feet, on August 18, 2010. The approximate locations of the test borings are shown on the attached Plot Plan, Figure 1. The soils were logged by the undersigned. The boring logs are presented in the attached Figure 2, and are summarized in the following section. SUBSURFACE FINDINGS The soils encountered in the test borings consisted of moist, loose to medium dense, silty sand to a depth of 2.5 to 3 feet, underlain by moist, medium dense to dense, silty sand to the maximum depth explored of 8 feet. Thc soils have a very low expansion potential, (Expansion Index less than 20). No groundwater or seepage was encountered. Martin R. There are no known geologic hazards, such as landslides or mapped, earthquake faults at the site. However, the building is subject to ground shaking and possible damage from earthquakes on nearby, or more distant, active faults. SEISMIC DESIGN VALUES The following, 2007 CBC, seismic design values arc applicable. These values were obtained using the USGS Earthquake Hazards Program. The primary, geotechnical consideration is the presence of an upper, 2.5 to 3-foot layer of loose, surface soils. These soils are unsuitable for building support and should be removed and recompacted prior to construction. RECOMMENDATIONS 1. EARTHWORK AND GRADING • Removal of Surface Obstructions All surface obstructions, including concrete and other debris from existing garage removal, tree roots and other organic materials should be cleared from the site. • Removal of Unsuitable Surface Soils Surface soils within building areas, and to a minimum, horizontal distance of 5 feet outside building limits, should be removed to a minimum depth of 3 feet below existing ground surface, or 18 inches below bottom of footing elevation, whichever is greater. Actual removal depths should be verified by the Geotechnical Engineer during grading. Martin R. Any import fill should be predominantly sandy and low expansive, and approved by the Geotechnical Engineer. • Compaction and Method of Filling Prior to placing fill, the exposed subgrade soils should be scarified to a depth of 6 to 8 inehes. moistened or dried to slightly above optimum moisture conditions, and compacted by mechanical means to at least 90 percent relative compaction. All fill should be compacted to a minimum relative compaction of 90 percent as determined by ASTM D1557. Fill should be placed at slightly above optimum moisture conditions, in lifts 6 to 8 inches thick. All earthwork, fill placement and compaction should be performed in accordance with the grading requirements of the City of Carlsbad. Grading observation and fill placement and compaction should be observed and tested as necessary by the Geotechnical Engineer. • Trench Backfill Utility trench backflll in building areas and beneath pavements should be compacted to a minimum relative compaction of 90 percent. 2. FOUNDATIONS • Footing Depths The proposed two-story residence may be supported on continuous and/or individual spread footings bearing in compacted fill at a minimum depth of 18 inches below building pad grade or lowest adjacent ground surface. All footing depths should be verified by the Geotechnical Engineer. • Reinforcing of Footings Minimum reinforcing of continuous footings should consist of four No. 5 rebars, placed two at the top and two at the bottom of the footings. • Allowable Soil Bearing Value Footings in compacted fill may be designed for an allowable, dead plus live bearing value of 2,000 pounds per square foot, with a one-third increase for short term, wind or seismic loads. A soil/concrete friction factor of 0.35 may also be used. When combining friction and passive resistance, the passive resistance should be reduced by one-third. • Anticipated Settlements Total and differential building settlements should be less than Vi inch for footings designed as above. • Cleaning and Inspection of Footing Excavations Footing excavations should be thoroughly cleaned of loose soils. The Geotechnical Engineer should inspect and approve all footing excavations prior to placing reinforcing steel. 3. FLOOR SLABS Floor slabs should be at least 5 inehes thick and reinforced with No. 4 rebars placed at 18 inches on centers in two directions, and supported on concrete blocks at mid-height in the slab. Floor slabs should be underlain by a 4-inch layer of clean sand. A iO-mil visqueen moisture barrier should be placed at mid-height in the sand layer. Some shrinkage cracking of floor slabs is possible. 4. EXTERIOR SLABS Exterior slabs, including driveways, should be at least 5 inches thick and reinforced with No. 4 rebars placed at 18 inches on centers in two directions and supported on concrete blocks at mid- height in the slab. Exterior slabs may be constructed directiy on the existing sandy soils, provided the upper 12 inches of soil is compacted to at least 90 percent. Expansion joints should be provided at 10 feet maximum spacings. Some shrinkage cracking of exterior slabs is possible. 5. SURFACE DRAINAGE Surface drainage should be directed away from building foundations. Roof gutters and downspouts should be provided and connected to solid outlet pipes that discharge water away from foundations to an approved outlet. Martin R. Prior to formal application submittal, it is suggested that the following comments be resolved or addressed: 1. When the application for development permits is submitted, a complete a Stormwater Standards Questionnaire will be required. This questionnaire will guide you and the City in determining what type of reports and storm water mitigation must be completed to satisfy state and City storm water quality requirements. The questionnaire can be printed from the following website link: http://www.carlsbadca.gov/engineering/chklstpdf/stormwater-qstnn.pdf Some best management practices (BMP's) to consider include pervious pavement on the parking areas exposed to runoff and directing driveway, parking lot drainage and roof drains through grass swales. Both BMP's are effective at removing pollutants and reducing runoff quantities. A complete list of BMP's can be found in the City's Standard Urban Storm Water Mitigation Plan (SUSMP). The Questionnaire results will most likely designate the project as a priority project and therefore require submittal of a Storm Water Management Plan (SWMP). 2. Indicate the proposed grading quantities. A grading permit will most likely be required. Include topography and spot elevations to show existing and proposed drainage conditions. Existing drainage patterns for all lots adjacent to this project (extend topography 30') should be included. The proposed development will increase impervious surface which could increase runoff. Please address this issue and mitigate impacts if they develop. PRE 09-10 PRELIMINARY REVIEW 3. Plot all public street utilities and show sewer laterals and water services. If the project is later converted to a condominium project, separate water meters and services will be required. It is the Planning Director's determination that the project CDP 10-25 - LEE RESIDENCE, is consistent with the applicable Coastal Development Regulations (Chapters 21.201 - 21.205) and with all other applicable City ordinances and policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15303(a) - New construction of small structures, ofthe California Environmental Quality Act and a notice of exemption will be filed upon project approval. The Planning Director, therefore, APPROVES this request based upon the following: 1. That the total cost ofthe proposed development is less than $60,000. 2. That the proposed development requires no discretionary approvals other than a Minor Coastal Development Permit. 3. That the development is in conformity with the public access and public recreation policies of Chapter 3 of the Coastal Act, in that the property is not located adjacent to the shore. Therefore, the project will not Interfere with the public's right to physical access to the sea and the site is not suited for water oriented recreation activities. 4. That the proposed development is in conformance with the Mello II segment of the Certified Local Coastal Program and all applicable policies in that the development consists of a new second dwelling unit and the development Is consistent with the Mello 11 Land Use designation of RH. The proposed second dwelling unit located above a detached garage is consistent with the surrounding development of one-story and two-story single-family structures. The second dwelling unit will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty ofthe coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The proposed second dwelling unit is not located in an area of known geologic instability or flood hazard. The site is located In close proximity to the coast but no public opportunities for coastal shoreline access are available from the subject site. The residentially designated site is not suited for water-oriented recreation activities. 5. The project is not located in the Coastal Agricultural Overlay Zone, according to Map X of the Land Use Plan, certified September 1990 and, therefore, is not subject to the provisions of the Coastal Agricultural Overlay Zone (Chapter 21.202 of the Zoning Ordinance). 7. That the request for a minor coastal development permit was adequately noticed at least fifteen (15) working days before the date of this decision pursuant to Section 21.201.080(B) and (C) of the Carlsbad Coastal Development Regulations. 8. That the Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303(a) "New Construction of Small Structures," of the State CEQA Guidelines and will not have any adverse significant impact on the environment. 9. That the Planning Director has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact caused by the project. Conditions: 1. The Planning Director does hereby APPROVE the Minor Coastal Development Permit No. CDP 10-25, for the project entitled "LEE RESIDENCE SECOND DWELLING UNIT" (Exhibits A-L), dated January 7, 2011, on file in the Planning Division and incorporated by this reference, subject to the conditions herein set forth. 2. No vested rights are gained by Developer or a successor in interest by the City's approval of this Minor Coastal Development Permit. 3. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Minor Coastal Development Permit documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development different from this approval, shall require an amendment to this approval. 4. The Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. 5. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Minor Coastal Development Permit, (b) City's approval or issuance of any permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation ofthe facility permitted hereby. 7. This approval shall become null and void if building permits are not issued forthis project within 24 months from the date of project approval. 8. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD #1 special tax (if appiicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. Ifthe taxes/fees are not paid, this approval will not be consistent with the General Plan and shall become void. 9. Prior to the issuance of the building permit. Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the Planning Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Minor Coastal Development Permit on the property. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The Planning Director has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. 10. Approval of this request shall not excuse compliance with all applicable sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance, except as otherwise specifically provided herein. Engineering: 11. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, developer shall apply for and obtain approval from, the city engineer for the proposed haul route. 12. This project is approved upon the express condition that building permits will not be issued for the development of the subject property, unless the district engineer has determined that adequate water and sewer facilities are available at the time of permit issuance and will continue to be available until time of occupancy. 13. Prior to approval of any grading or building permits for this project, developer shall cause owner to give written consent to the city engineer for the annexation of the area shown within the boundaries of the site plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 and/or to the formation or annexation into an additional Street Lighting and Landscaping District. Said written consent shall be on a form provided by the city engineer. 15. Prior to issuance of building permits, or grading permit, whichever occurs first, developer shall cause owner to execute, for recordation, a city standard Local Improvement District Agreement to pay fair share contributions for undergrounding of all existing overhead utilities and installation of street lights, as needed, along the subdivision frontage, should a future district be formed. 16. Developer shall comply with the city's Stormwater Regulations, latest version, and shall implement best management practices at all times. Best management practices include but are not limited to pollution control practices or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices or devices to prevent or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent practicable. Developer shall notify prospective owners and tenants of the above requirements. 17. Developer shall complete and submit to the city engineer a Project Threat Assessment Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF, developer shall also submit the appropriate Tier level Storm Water Compliance form and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) as determined by the completed PTAF all to the satisfaction of the city engineer. Developer shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee schedule. 18. Developer is responsible to ensure that all final design plans (landscape plans, building plans, etc) incorporate all source control, site design, and Low Impact Design (LID) facilities. Specifically, the Building plans shall include details for the installation and plumbing of the proposed cistern rainwater recovery system. 19. Developer shall incorporate measures with this project to comply with Standard Stormwater Requirements per the cit/s Standard Urban Stormwater Management Plan (SUSMP). These measures include, but are not limited to: 1) reducing the use of new impervious surfaces (e.g.: paving) and, 2) designing drainage from impervious surfaces to discharge over pervious areas (e.g.: turf, landscape areas), all to the satisfaction ofthe city engineer. 20. Developer shall meet with the fire marshal to determine if fire protection measures (fire flows, fire hydrant locations, building sprinklers) are required to serve the project. 21. The required setbacks for the R-3 zone includes: 20 foot front yard setback, 10% of the lot width for side yard setbacks, and 20% of the lot width for the rear yard setback. As shown on the plans, the proposed addition is in conformance with the required setbacks. 4. The maximum square footage of living area for a 2""^ dwelling unit is 640 square feet. Please show on the plans how the 2"*^ dwelling unit complies with this requirement before a formal submittal. 5. Please remove the 4' 9" setback note shown for the garage which is going to be demolished. 6. The distance between buildings used for human habitation and accessory buildings shall be not less than ten feet. The proposed addition complies with this requirement by providing an approximate 21 foot separation. 7. The maximum allowable building height for habitable space in the Beach Area Overiay Zone (BAOZ) is 30 feet with a roof pitch of at least 3:12, or 24 feet maximum with a roof pitch of less than 3:12. The proposed project does not show a roof pitch of at least 3:12 and will be subject to the maximum height limit requirement of 24 feet. Please revise the habitable portion of the building which extends above the height limit to either have a roof pitch of a minimum 3:12 or a maximum height of 24 feet before a formal submittal. 8. The maximum allowable building and structure lot coverage for the R-3 zone is 60%. Please include the total calculated lot coverage on the plans with the formal submittal. 9. An affidavit of compliance for the 2"" dwelling unit will need to be signed and submitted with the submittal of the Minor Coastal Development Permit to the Planning Department (see attached). 10. The 2"*^ dwelling unit shall be architecturally compatible with the main dwelling unit in terms of appearance, materials and finished quality. Staff encourages a redesign of the exterior to incorporate additional elements in order to comply with the above mentioned information. Areas of emphasis should focus on the following: a. Multiple building planes for the rear and right elevations. Minimum offsets should be 18 inches and can include building walls, windows, porches and roofs. b. Addition of architectural design details on the rear and right elevations, including, but not limited to, balconies, decorative eaves and fascia, exposed roof rafter tails, arched elements, and columns. 11. The main dwelling unit is currently "existing nonconforming" because of an inadequate side yard setback. Any future additions, attached to the main unit, are limited to 273.2 square feet. City staff is currently working on an amendment to Chapter 21.48, Nonconforming Buildings & Uses, which may allow a lot that is "existing nonconforming" to apply for an administrative permit that would allow expansions up to the development standards for the underiying zone. Please feel free to contact the Planning Department to inquire about the status of the ordinance adoption if an expansion is being considered in the future. Please review all information carefully before submitting. Engineering: Engineering Department staff has completed a preliminary review of the above subject. Prior to a formal application submittal, it is suggested the following comments be resolved or addressed: 1. When the application for development permits is submitted, a complete a Stormwater Standards Questionnaire will be required. This questionnaire will guide you and the City in determining what type of reports and storm water mitigation must be completed to satisfy state and City storm water quality requirements. The questionnaire can be printed from the following website link: http://www.carisbadca.aov/engineering/chklstpdf/stormwater-gstnn.pdf Some best management practices (BMP's) to consider include pervious pavement on the parking areas exposed to runoff and directing driveway, parking lot drainage and roof drains through grass swales. Both BMP's are effective at removing pollutants and reducing runoff quantities. A complete list of BMP's can be found in the City's Standard Urban Storm Water Mitigation Plan (SUSMP). The Questionnaire results will most likely designate the project as a priority project and therefore require submittal of a Storm Water Management Plan (SWMP). 2. Indicate the proposed grading quantities. A grading permit will most likely be required. Include topography and spot elevations to show existing and proposed drainage conditions. Existing drainage patterns for all lots adjacent to this project (extend topography 30') should be included. The proposed development will increase impervious surface which could increase runoff. Please address this issue and mitigate impacts if they develop. 3. Plot all public street utilities and show sewer laterals and water services. If the project is later converted to a condominium project, separate water meters and services will be required. Also, if a fire sprinkler system is required, show the One (1) inch service from the street main and double detector check valve assembly (DDCVA). The DDCVA must be on private property. 4. If a condominium project is later proposed, an application submittal for a Minor Subdivision will be required. 5. Plot the existing overhead utilities on Garfield Street. Fire: Fire Department comments are still in review and will be provided separately as soon as they are available.
