The City Planner has completed a review of your application for a consistency determination
regarding the proposed changes to an approved Coastal Development Permit and Special Use
Permit (CDP 11-20/SUP 11-05) to allow modifications to an approved new single family
residence (APN: 208-040-14) generally located on the north side of Eucalyptus Lane, west of
the intersection of El Camino Real and Crestview Drive. The proposed modifications include:
• Relocate the proposed house on Parcel 2 twenty five feet to the west; and
• Install a 42 inch retaining wall at the southeast corner of the pad.
In order for a Discretionary Permit Consistency Determination to be approved, all of the
following findings must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been
considered essential to the project's design, quality, safety or function.
2) The request represents an upgrade in overall design features and or materials and
improves upon the project's compatibility with the surrounding neighborhood.
3) The proposed revision does not change the density or boundary of the subject property.
4) The proposed revision does not involve the addition of a new land use not shown on the
original permit.
5) The proposed revision does not rearrange the major land uses within the development.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the
Carlsbad Municipal Code.
7) The proposed change will not result in any significant environmental impact, and/or
require additional mitigation.
8) The proposed change would not result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project
which would be exacerbated with the proposed change.
1 0) The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application QUALIFIES for a consistency determination as the project is
consistent with the Residential-Agricultural Zone and El Camino Real Corridor Development
Standards and therefore, APPROVES the changes to the project based on Planning Division
Administrative Policy No. 35.

Unless otherwise specified herein, all conditions shall be satisfied prior to the initiation of project
construction.
1. Please submit two (2) blueline copies (24" X 36") of all applicable exhibits (site plan,
floorplans, & elevations) for the project file. The blueline copies must be submitted,
stamped "Consistency Determination," and signed by the City Planner prior to issuance of
any building permits for the project. The Consistency Determination Title Block stamp, and
other Title Block stamps, can be downloaded from the City's website at
http://www.carlsbadca.gov/services/departments/planning/Pages/applications.aspx. The
Title Block (stamp) is located under "Resources" on the right side of the page.

Engineering:
Land Development Engineering has completed a review of the above-referenced project. Engineering
issues which need to be resolved or adequately addressed prior to staff considering the proposal as
consistent with the original COP are as follows:
1. Verify that SDG&E finds that the proposed house encroaching into their 20 foot wide tree
trimming easement is acceptable or relocate the house outside the easement.
2. Since the drainage swale between the house foundation and both proposed retaining walls is
less than the required 5 feet per City Standard Drawing GS-15, redesign to the standard or
provide a letter from a certified soils engineer validating that a lesser distance will not result in
any structural or geotechnical failures.

You and I worked on this project at the corner of Eucalypyus Lane and Crestview Drive about 6 months ago in Carlsbad.
The owners are going to start construction on the project.
The house they have designed for Parcel 2 (see attached) encroaches into SDG&E's tree trimming easement. I do not
believe it is a problem but the City of Carlsbad needs confirmation from you that it is O.K.

Co. of Carlsbad, California to address surface drainage betv .. ~:cn the proposed retaining walls and
the singk-l~tmily residence on Parcel 1 at the subject sit<:.
It is our understanding that two retaining walls will be located approximately 4 feet [[·om the
proposed residence. Drainage should be designed for a minimum gradient of 2 percent in
hardscapc areas and 5 percent in eanh areas. Earth S\vales should have a minimum gradient of~
percent. Drainage should be directed to appronx1 drainage facilities.
